I was medically discharged in 1990 at 30%. I now know I
meet all the medical requirements for 100%. So they did not apply 38 properly.
Or can I only go back to my first CnP after discharge ?

OK I found the answer with some more digging.
I would mail the CUE to the evidence intake center.

I am going to CUE a decision from 1996. Do I mail it to the RO that made the decision or
to the evidence intake address on the back of decision we get now ?
I live far from the RO that made the decision in 1996/

I have several conditions awaiting DRO review. I have identified s few CUEs with the decisions. Can I claim a CUE when the decision is awaiting a DRO review or is it to late ? If not now when can I file CUE?
Also can I request amend medical records when waiting for DRO review?
Everyone of my DBQs done at CnPs is full of inaccuracies that can be proven with my medical records.
I am thankfully for the VA but this process is beating me down and the learning curve is long.

Hello and thanks to everyone on this site for all the info. I just faxed off my first
"implicit denial" AND 38 CFR 3.156 (c)(2) claims . Thanks to the info on this site.
I have a bunch more of those to do.
My question is, Can I use BVA decisions as evidence in my case? I read some where that we can not
but yet the VA uses them as case law. That seems very one sided to me.
A little on my case.
SC Ulcerative Colitis for over 20 years . I have used Prednisone a lot. Now my spine is
DDD bad. Common knowledge that Prednisone does this. Even the makers of Prednisone print
this as a side effect. I have read BVA cases and sometimes they SC it and sometimes they don't,
these cases are the same as mine. SC Colitis + pred = bad back.
It would be nice to use the BVA cases that grant SC as evidence.

Berta thanks a bunch. The info you have posted in this and other posts is helping me out a lot.
I lost my job in 12/2015 due to the consequence of my service connected disability. I have been
reading my medical records and VA law since then. It has taken me over two years to find this CUE and
know what a CUE is. Currently I am working on a CUE from a 1996 CnP exam. All my CnPs seem to be very inaccurate.
When I am done writing my CUE is it possible to have one of the experienced people on here take a look at it before I submit it. ??
I am trying to get a local VSO to look it over also but they are very busy. I have well over 7000 pages of med records so don't think any VSO is going to read them like I do. At one point my med records disappeared from the blue button. When they magically repapered over a year later they have been altered. I have a saved copy of unaltered on my computer. Is this commom with the VA.?? I know the clinic I go to has been in trouble for deleting med records, but altering them is just as wrong.
