    Rarely, the money comes first, then you get the VARO decision.  

    Remember, you can appeal ANY PORTION of a board decision, including effective date, percentage, SMC, etc, "even when" another portion of the decision is denied, granted, or remanded.  

    As always, if you chose to appeal a board decision, get after it right away, you dont get a full year to appeal..only 120 days.  So read the board decision carefull, ask hadit if its unclear, and decide if an appeal is warranted.  

    "Remands" can not be appealed because they are not final decisions..a remand means it is sent to someone else to readjuticate, in compliance with the remand instructions.  Awards can be appealed, if you dispute the effective date or disability percentage.  

    Greetings! What is an VA Implementation document or what does it look like?  I received documents from the BVA (dated 23 May 2022) and VARO (dated 31 May 2022)  explaining the details of the Grant. I called DFAS today and they don't have a request for an Audit from the VA.  Can this mean the VA will do the recalculation and deposit what ever Retro I'm due into my bank account?

    I would love to take my wife on a trip back to Hawaii and spend at least 30 days or more. Thanks on the money investment tips. Technology has drastically improved over the years so retro pay and other audits should be alot quicker. Right!

  3. Greetings! Let me ask this question so to get a better understanding: If I was awarded 30% in 2000 for three years (2000-2004). The Grant increased that rating to 40%.  Would I get the difference?

    Thanks for the Retro payment breakdown process.  It's been 10 days since I received the BVA and VA rating decision letters...no deposit yet. My last DFAS Audit was in 2018. As a result of my Grant,  my new ratings from 2000 to 2009 were increased. Will those increases require another DFAS Audit?

    No audit but a recalculation of the difference of your benefits. The RO will determine your retro pay by calculating what they owe you minus what they paid you, then pay you the difference. Keep an eye on your bank account, you will most likely see the funds before your get the RO Decision. You should also get a separate BVA decision to let you know of your grant. Now if the BVA also remanded anything, this may put a hold on things, and it will move slow, but I would say it should take a few weeks.

    My legacy remanded claims (Docket 11-12 911) was Granted by BVA Law Judge on 23 May 2022. My 100 percent P&T was backdated from 2015 to 2009. Will there be an audit before retro pay?

I searched my medical files and found a document stating my seizures were witnessed by ER medical staff at Tripler Medical Hospital in 2012.  Should I submit that report to the VA now or wait until I get their decision letter first. Currently,  eBenefits show that I was rated for TIA at 10 percent with no seizure activity. Please see attached document.

    Greetings 

    I haven't received my rating decision letter yet. They could be waiting on a C&P exam for my three remanded claims. I'm scheduled for an examination of my legs and feet next week.  Everything takes time.  I'm still curious about the attached document which a seizure condition was witnessed by ER medical team that may have been overlooked when the BVA granted my TIA claim. Everything bit of evidence is important.

  8. Greetings! I was recently granted service connection for hemorrhagic stroke by the BVA.  My appeal was received Mar 2010 and granted 21 Apr 2021. How will that granted service connected claim be rated?
    One Granted: Service connection hemorrhagic stroke
    Three Remanded:
    -Service connections Degenerative Arthritis
    -Service connection Bunion
    -Increased rating Diabetes
    Two Denied:
    -Increased rating -Lumbosacral or cervical stroke
    - Increased rating, Sciatic nerve paralysis
