  1. Is that time before or after the folks do the doctor shopping thing? Sorry to be such a downer, but this has just happened to me after 6 years waiting. I guess National Institutes studies, China's Orthopedic Hospital studies, Finnish Research studies, as well as, the doctrine of equipoise, or doctors statements more likely than not,,,is enough evidence to determine some claims.:dry:: Which begs the question: Could the government spending money on research that the government ignores be a frugal use of taxpayer money? And, could that be part of the government deficit that is in the news?

  2. Hey Fed,,,,, hold up....I think about everybody here (thousands) can understand your frustrations. The first thing you don't want to do is get in your own way. I think too, that what may be a discovery for you has been well known by most here, especially the seniors. i.e. you are preaching to the choir,,,now get up off your knees, wipe your eyes, focus and fight your battle. You have lots of help here. Pardon also, Fed,,,for the sake of all,,,please try to check your i's and t's before you present them as facts here. There are those who depend on the site for information that is as close to the facts as possible. (ex. 1. GAO tells the Board of Veteran's Appeals how to instruct the medical examiners to examine the veterans and how to word the diagnosis; (I doubt they tell the doctors what to do or say aside from the law. Think about it, if they did you wouldn't know it anyway.) 2. The VA convienently disregards approval by the Social Security Administration for disability when submitting that as evidence in a claim of any kind. (Almost anybody here can tell you that something is either SC or it's not and if the SSA report/approval gives evidence that something they (the SSA) approved is connected to your SC condition, then the SSA report can be strong evidence for your claim. If your SSA claim is for something other than a SC condition or secondary to a SC condition, then it wouldn't count anyway.) JUST SAYIN and I'm outta here. Good Luck.

  3. This is another thread from the question about CHAMPVA being secondary to Medicare. I did this so the two would not be co-mingled, as I feel both are separate legitimate questions. My question is: Do State Health Departments accept Champva where you are? Mine does not except in certain "special" (home health, etc.) circumstances. My wife went in for some tests and she was told that they did not accept Champva. The bill is almost paid now (I think we may owe 5 bucks or so). I just thought I would throw the question out there. By the way, I live in a small town,,,though we do have a hospital.

  4. Does a 100% P and T preclude IU? If IU is initially granted and a separate condition is rated at 100% independently of the rated body system that presents the IU, is the independent 100% cause for SMC?

  5. The BVA is going into hiding. They will be at an undisclosed location. Ex-Vice President Chenny will be the only person able to communicate directly with the BVA. I have heard through secret sources they will be ten miles underground in gigantic bomb proof complex with the CIA next door. All this because of Nehmer.

    VA Claims Research This is a good forum to put general claims questions or if you aren't sure where to put it. There are several forums that deal with specific issues, such as TDIU. PTSD etc look over the various forums and post in the one you feel best fits your question

  7. First and foremost, I will stick up for Berta, who has helped hundreds. Altho she is not perfect either, she has volunteered her time and efforts to help, literally, hundreds of Vets, to which I am one. I may add that she is one of the best, if not the best researchers available. I have read hundreds of Berta's posts as well as hundreds of articles written by the well known Jim Strickland on watchdog. Berta's responses are better than Jim's, as her knowledge has more "depth". Berta will think nothing of researching case law for 2 hours to help a Vet, and I do not see that kind of "depth" with Jim Stricklands answers. Berta's answers are much more detailed than Jims. Jim gives good answers generally on the RO level, but for appeals, Berta wins this contest hands down. I just have not seen Jims answers demonstrate that he has researched case law on his answers, while Berta's answers often do this.

    The difference is that Jim Strickland wont be rating or making a decision on anyones claim, while Berta researches opinions and cases of people who DO adjuticate claims.

    It is your choice of who to follow the advice: Jim Strickland, who shoots from the hip, or Berta, who consults what judges have decided. I know my answer.

    There is, IMHO, ONE and ONLY one poster (on the net) who has knowledge of VA law even close to Berta. That would be "Ask Nod". Like Berta, Ask Nod has read thousands and thousands of VA cases. Berta's speciality is Widows benefits, while Ask Nod's is hep C and service connection.

  8. Hello Bronc..... That is an incredible story that sent goose bumps up and down my arms and it shows that sometimes we never know when or why these things happen. To have your son protected sounds just like divine intervention. I also have a hard time knowing that His Son took the worlds place on that cross. It is way too big for me to even comprehend or understand , but I can only accept and BELIEVE. Just as you did. Amen. There are so many others like your son and like you and like me and its so important that we continue to try and help those that have come after us , because one day they will be like us trying to support those that come after them.     just sayin.......but since you (YOU<<<YOU) recognize that the doc's statements are incorrect, I would bring it to the VA's attention as soon as you get something in writing saying the doc is putting words in your mouth. Not to be an alarmist,,,BUT,,,you know the government, somehow it will be your fault that the doc put the wrong thing down....(knew or should have known garbage)......ouch,,,,,OUCH,,,,,what was that? Uh Oh,,,it's the doc's statements that I said thus and so biting ME in the butt. Better safe than trying to explain away what the doc said on your behalf...Maybe the doc was trying to help your case,,,,,but it is easier to bring it out than for them to hold up your benefits while you try to explain what it was exactly that you said. JMHO

  10. MERRY CHRISTMAS EVERYBODY.... I want to thank you ALL again. Thanks for allowing me on the board and thanks for the help. I am done except for some appeals that I am having fun with, fighting the C and P folks. For all you other fellow vets,,,you can trust the folks here to tell you the best that they know. Follow their lead and unless your claim is completely bogus, they can show you the way here. At the very least, for me at least, it has made the waiting bearable. Enjoy,,,,and again remember the reason for the season. BE HAPPY.

  11. And the VA says,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,,DENIED. I was an apprentice welder on the America (CV66) and a fire watch while we were in overhaul in Portsmouth,,,constantly exposed,,,,rated by a Government "B" Reader, got paid from several companies,,,took two more tests, both confirmed asbestosis...and the VA says,,,,,,,,,,,,,,DENIED. So get ready to fight.

  12. Emily,,,this is Larry L. I understand your frustration, I have an appeal with the BVA that has been there since 06. But remember, (smile), the folks at hadit are all just like you,,,I don't think anybody here is with the BVA, so while you may be angry, don't get angry with the folks here...They are here to help and many of them are as frustrated with the system as you are.   13. Might as well start here after thanking the big boss upstairs. I was a broadcast journalist at some point in my career (the last 9 years), however, I can only find one thing to say to ALL you guys (to include the ladies) moderating and the guys and gals chiming in (as you guys say).
