  1. Long story short, when I went in for my TBI exams the Doctor told me I had PTSD in addition to TBI. But I was afraid of losing my security clearance so I asked her not to mention the PTSD in her report and she was kind enough to honor my request. Now a year later, I found out you do not have to report any sessions with a psychologist or psychiatrist if it is related to combat experiences. So I have requested an appointment with the mental health team at the VA.

    Now my question, will the mental health team provide a diagnosis of PTSD after meeting with them? I know i have PTSD and have decide I need help, but would also like to file for service connection. Would it be worth while to call the psychologist I saw last year at the TBI clinic?

  2. I would wait until you get the MRI results. Include everything you have, the more the better. The good news, you have one year from seperation / retirement for arthritis to show up so the recent tests will count. I don't know about the final physical questions, but I would guess that as long as you were on active duty and the Doc noted it you should be covered. But that doesn't the mean the VA will pay you for it, they might throw a bunch of SC 0%. at you But once you are SC 0%, you can begin to document the problems and submit new evidence and ask for an increase.

  3. Wow, 70 and 70 that is great. At the time of the TBI eval, the DoD required the reporting of any sessions with Phycologist or Psychiatrist, but since then they have change the Clearance requirements that you do not have to report any treatment that was for symptoms from "war" So now I might go back to the Phycologist and see what she says.

  4. is it possible to be rated for both TBI and PTSD or would that be pyramiding?

    The reason I ask, when I meet with the Phycologist during my TBI testing she said I have both PTSD and TBI. But I asked her not to report the PTSD because of my job / security clearance. I have since been rated at 40% for Cognitive Disorder NOS residual of TBI and just wondering if the PTSD would even have an effect on my rating.

  5. I previously requested and received a copy of my C-File and I remember it said you can only get one copy. Is it possible to get a copy of the new material since the first request? I have a new 40% rating for Cognitive Order NOS with residual of TBI, but I believe it should be 70% based on the testing results and want to see what, if any, information the rating official reviewed other than the info I submitted.

  6. I received the official VA letter and it says cognitive disorder NOS with residual of TBI, but does not list a specific code. However, in the explanation they go over the different areas under the TBI rating so i am pretty sure that is what the rating is for.

    But, I noticed in their explanation they quote the VA tesing and Doctors explanation as clinically significant decline in memory. But then go on to say that is a only mild impairment. Does anyone think the clinically significant decline in memory should be "moderate"

  7. I did the full tests at the VAMC, twice actually. The first was 2-3 hours and the seoncd was about 7 hours. Then went through the interviews with the Doctors and Speech Therapists. The testing was pretty significant and the results said 2 standard deviations below normal for immediate memory and 1.5 below delayed memory.

    James, is the cognitive disorder NOS with residual of TBI, different than TBI (8045)? I specifically requested compenstation for TBI (8045) based on the test results and VA Doctor diagnosis. How do you request a C&P, if they didn't reschedule it after I had to cancel the first one.

  8. So I applied for TBI Rating after failing the memory testing, etc, during the TBI screening and sebsequent testing. I had a C&P Exam scheduled in Aug but had to cancel it because my step-Father passed away. Then yesterday I received a letter from the DAV telling me the VA has awarded me 40% rating for Cognitive Disorder with residual TBI. DAV said I should recieve the offical paperwork from the VA soon. I am very surprised the VA settled my claim without a C&P Exam. The only thing I can think of, maybe they used the results from previous C&P exams for other ratings and combined them with the results of the TBI testing.

    I am appreicative of the 40% rating, but after reading the rating schedule I believe I may be eligible for 70%. The difference is evidence of mild (40%) or moderate (70%) memory impairment from testing ..... with mild (40%) or moderate (70%) functional impairment. Does anyone have any idea how they quantify mild versus moderate on the test results and functional impairment? I might except this rating since I am able to keep my job.
