On September 14, 2005 the United States Court of Appeals for Veterans Claims remanded my back to the Board of Veterans Appeals with a court order that they locate my original claim folder and the BVA remanded my claim back to the (VARO) in New York City with the court order to locate my original claim folder.

    On May 13, 2009 the BVA received my appeal from the (VARO) in New York City upon completion of the remand order and also granted my request to advance my appeal on the docket!

    On June 18, 2009 the BVA remanded my appeal back to the (VARO) in New York City instructing them to follow the Joint Motion granted by the United States Court of Appeals for Veterans Claims! And search for my original claim folder as instructed in the Joint Motion granted to me by the (COVA). Now I see where remand order fraud is causing the backlog within the VA system....... is there anything a veteran can do to eliminate this "remand order mess".

  2. I have a veteran that is a senior and he is working part time somewhere around (20) hours a week. He won't file a claim for compensation because he doesn't want to stop working and he was denied based upon the fact that he was working!

    Can a veteran be denied compensation based upon him having a job working (20) hours a week or does he have to quit his job before he appeals his claim for VA compensation benefits?

  3. I received Supplemental Statement of the Cases on September 10, 2008 and March 23, 2009! The VA Form 9 will be filed this week and it has no additional evidence attached, we're requesting the reconstructed claim folder be sent to the Board of Veterans Appeals and I am wondering whether there are any VA laws or regulations which holds the VA to time a period, example (60) days or something like that! Is there anything in place to hold the VA accountable to how they respond to the VA Form 9?

  4. Hello everyone and how are you doing. I am in need of some information concerning my claim. What are SMC "S" or SMC levels.

    I am 100% rated for PTSD and my original claim was for heart condition in 1992 but I received the above rating and the heart condition was denied!

  5. Hello brothers and sisters United States Veterans of America. I am wondering if there is any veterans available from the Albany New York or even New York State that has been affected by the paper shredding and backdating of the VA database in the Regional Office in New York City. If so can we talk because this cannot be swept under the rug or placed on the House Committee on Veterans Affairs back burner!

    We need to get together and speak in love to this situation in numbers and we will be heard without a doubt. I have made plenty of media contact and they have ask me if there is any veterans in Albany New York or New York State that I know have been affected by this scandal.
