  1. I recently got the results back from my C&P exam. The shrink left out pertinent information that I told him. The file is not at the raters yet. Can I still send in infomration that he left out. Also documents that I wanted him to take he said he just made notes.

  2. It's been a while but I filed for OCD and had my c&p last week got the results back today...I don't think they are so good. My psychiatry consult list my diagnosis as ocd and anxiety which i am taking medicine for. my social worker list my treatment as depression. I was hospitalized in the service for sex addiction...in which we had counseling session that said it was due to acts that happened in the military. In my miltary record jacket it does not include any of the notes from the counseling sessions.

    The examiner says in his notes that I don't meet the diagnostic criteria for ocd due to the fact he obtains pleasure from this activity. Which i don't know how he can say that because I don't and he never asked that question. He never asked if I got enjoyment from my ocd. He also states that i present symptoms congruent with a diagnosis of major depressive disorder.

  3. Would like to get some help on what to do now that I've a decision back from VA. I appreciate any help you guys can provide.

    I am looking to get compensation for my pes planus, back, shoulder. I am 0% for pes planus denied for back and shoulder. The c&p examiner noted pes planus bilaterally. An xray noted mild hallux valgus on left foot. I went to the VA podiatrist last week and she noted pes planus b/l metatarsalgia b/l interior calcaneal rim pain b/l and xerotic heels b/e

  5. Just got home from work to find the Va brown envelope in the mailbox.

    Decision

    bilateral ples planus = 0%

    shin splints is denied

    left shoulder injury denied

    thoracic back pain is denied

    As I am reading it seems that for the shin splints, back, and shoulder they want to see more chronic evidence. I feel so pissed at myself that I didn't read my va medical records to make sure that the doctors were putting down my problems. I ce pan't rewrite the past so now what do I do?

  6. I had a claim for pes planus that just got deceided> Received 0%. But I am going to pursue it. The ocd issue I would have filed for it but didn't know that I could until I looked on here. I requested a copy of my medical records from the VARO since they still have them because of claim I just got[ decided on. The issue does show in my smr because I was sent hospitilized for 21 days

    And forgive me for possibly repeating some starting questions - Do you have a copy of your service medical records? is the issue is in your SMRS, what was the given diagnosis? do you have your claims file, if you have one? Any private doctor exam notes relating to the same issue?

    Good you are at Hadit, cause it best to send in a good statement if possible, saves stress later.

  7. What do you mean by the stressor? I might have a problem I haven't really seen a doctor since military but I can prove in other ways the problem still exist.

    I will go ahead a send in a statement Monday. Do I have to mail it or can I take it directly there to the VARO seeing it's only a good 25 minutes away. It takes that long before a claim will possibly be paid out?

    anyway the biggest thing right now is getting seen. finally got an appointment

  8. How long after talking to mh should I wait to file for service connection. Should I go to multiple appointments first OR after they show the service connection (I plan to continue therapy).

    Right now my ocd takes up about 4 hours of my day everyday. Does any have the rating criteria for ocd.

  9. Went back down to the VA and go my progress notes. She did note pes planus b/l metatarsalgia b/l (which was note noted by c&p doctor. Xerotc heels b/l and Inferior calcaneal rim pain b/l. xray from nov 08 noted mild hallux valgus.

    One thing she said I didnt agree with is my complaining of back and hip pain I need to go back and see my pcp since they do not appear to be related to my foot pain. She wrote this even though I said my lower back get's worse the longer I stand on my feet. ????????

  10. I went to Va podiatry appt and found out a couple of things.

    1. I was told by the podiatrist that the orthotics that was made for me was incorrect and that is why I am getting not feeling better when I use them. So she is ordering a new pair for me but she said it might get rejected because the VA only makes 1 orthotics a year for a vet even though they made them wrong for me. She was really nice and said she would personally do a casting on my feet Thursday but if they actually make them that's another issue.

    2. In 2001 I went to the VA to get new orthotics made. I saw podiatry and they sent me to get some made. Why when I went to podiatry the doc said I was never made any new ones because they don't show it in the records. The only thing it showed was a podiatrist statement saying I came in for ankle pain and was told the orthotics was fine. But I was made orthotics. I am going to try and find the ones they made me..It is crazy. Maybe that is one of the problems why they just rated me at 0% because they don't show I came in 2001 and had orthotics made. How do I prove that one?

  11. Can I wait for disability maybe but if I was able to get 30% I would have been able to quit my part time job which I do need financially. My part time job is a position where I stand all the time I am there which is killing my feet which in return hurts my back. I have in my medical record a specific diagnoses for moderate pes planus and shin splints. I hurt my back which is labeled the thoracic region while moving boxes and I hurt my shoulder which was diagnosed as a strain muscle. For my feet and shin splints it is noted many times in my smr.

    I definetly am going to wait to see what information led them to their conclusion. Maybe it is something that can be easily proven.

    Actually, I just thought about this some more. Correct me if I am wrong on this. I take it you are not in dire straights for the disability compensation in order to meet your monthly financial obligations. I also take it that you do not have specific diagnoses for the conditions that you filed. I also take it that you do not have a clearly nexus for each condition to a event that occurred while you were on active duty.

    If all of these things are correct, then my advice is to not appeal this. You would only be denied again without all of the aforementioned items. Even if you did get all of the evidence required, you could wait years for a final adjudication in your favor, and still not have the earliest effective date preserved because the newly presented evidence would change the overall picture of the disability at a date later than that which you initially filed.

    The first thing you need to do is receive their decision letter. It will tell you exactly what you need to prove your case. The next step is to gather all of that evidence; cross all the t's and dot all the i's. Then, once you have a bullet proof case, file to re-open a finally adjudicated claim. It will start the process all over, but you will get a quicker decision, and you will not lose any retro money because the effective date of claim would be the date of the new evidence, regardless of whether you file a appeal or a claim to reopen.

  12. ;) The battle has begun. I talked to my DAV rep today and he said the my claims for pes planus, back, shoulder, neck and shin splints has been decided. I was denied on my back, shoulder, neck and shin splints. I was granted for pes planus but at 0%. For the life of me I can't figure how I was granted 0% for pes planus. It was noted on entrance exam but the doctor at the c&p said it was aggravated by the military plus the history of it in my smr plus have been seen by the VA since I got out and they made me custom orthotics plus sent me to physical rehab. I am shocked right now. Even my 4 year old can play connect the dots. I guess I shouldn't assume the VA is smarter than a 4 year old.

    Ok...so what do I do now. I have not receive my official letter yet I am just going by what my DAV rep told me this morning.

    I feel like the slow kid in my class just sucker punched me.

  13. it was noted on as moderate by a military doctor when i was in. At one point in my medical records it said i needed custom orthotics made but none were available. I hade to about a year until my next duty station before I was able to get any.

    With a strong c&p, looks like luck in on your side, sorry to hear about your feet though. VA prescribes orthotics inserts and support hose for me, helps me alot. My Quick question, did you have pes planus in your service medical records? or did the VA medical center or other provider note pes planus related to service?

    Whatever the outcome, ask questions here, check and double check your dates to help them get it right the first time around!

  14. To show you how messed up things are. I got a copy of my medical records and found a page talking about a hysterectomy. Since I am a guy I don't thinks it's mine...It has someone else's info on it..including service record number

    ....and, BTW.....that is R*A*M*P*A*N*T.......

  15. In my original claim I filed for feet, back and shin splints but they only did exams for feet and back. I'm not exactly sure what that means. I filed for benefits in Oct 08. So when things are approved I will get paid back to that date right? I originally went to the va after I got out of service and they made some orthotics for me because I had the same problems with my feet then as I do now Is it possibly they could pay back to that date if it showed in my records the problems were the same as I am having now?

    Oh...and keep an eye out for further problems. Over the last year I've developed achilles tendinitis, knee pain, and bursitis on one side and a flare up of shin splints and lower back pain. Yes, all are likely connected to flat feet, the pronation irritates everything.
