[1968 And 21-526 E Veteran Application For Compensation Or Pension At Seperation From Service]

My husband was hospitalized for 50+ days transferred from one hospital to the next for a LOD injury percussion or blast from month long artillary war games, which resulted in a delayed diagnosis which resulted in his right testes to become necrotic and reported on the pathology report as" extensive hemmorage and coagulation necrosis and a slit in the tunica albuginea" the final diagnosis was Infarcted right testicle. The 2 other diagnosis was "Epididymitis (nonveneral) and Torsion"

They removed the right testes ( Orchiectomy, unilateral) but did surgery on the left testes (Orchiopexy) which is usally done for testicle Torsion, I suspect they allowed him his right testicle to rot and 35 days of wait and see atitude which = incompetence,negligence or torture is how I see this type of treatment and my RN background.

Question original claim filed prior to discharge 21-526 e.

1. Are these claims handled differently today/

2. He was rated in 68 10% with 30% ( no pay) since recently of 2012

3. His original claim where the Togus Veterens Adm stamped has the date and a " NP" what does NP abbreviation mean I know it is not nurse practioner, but it is diffucult to find info on old claims from 68

4.He had one testicle removed and the other operated on and what should his original rating should of been? I was thinking 30% but with both affected would it still be 30?

5. I noticed on alot of his papers it is marked 00 under anatomical loss isn't that incorrect?

6.We have been married 32 yrs and 2 kids and never got any extra in all these years for dependents.

7. We are moving to Ocala area FL and I need to find a lawyer or a real good VA rep as I am the person doing all the research, writing letters etc as my husband can not cope with VA , As I need to file maybe a CUE claim or other claim due to the blatent mistakes of basically the claim from the beginning as I dig I find errors so argreacous. Why I need to find someone that I can trust to look and act on these mistakes and take action I can help as much as able but I have been quite ill for a year or more.

Any info would be so appreciated, I feel I am fight a blind deaf goelith..What a mess..

I totally agree with the fraud statement, I have been married to a Vietnam vet 32 yrs and he was injured loss a testicle and the other orchiopexy his care was watch and see and from 2-7-68 to 3-21-68 they wathched and see if his grapefruit size swollen testicle would return to normal he was initially diag with Epididymitis which many think of a VD the VA does but his was none veneral so when they decided to operate after about 3 weeks his right testicle was dead, necrotic , black, then they diag Torsion as final diag. his diag 1. 6140 epididymitis, acute, right testes , Not PR LOD:Yes diag 2. 6170 Torsion, right testes, old with necrosis of testis , Not PR LOD: Yes and then surgery operation; 1. 571 Orchiectomy, unilateral, general anesthesia 2. Orchiopexy ,left, same anesthesia.form DA 8-275-2 these medical records have been in my husbands possesion since his 1968 discharge. But around 2009 I got records from NPRC and what a shock the VA had altered my husbands medical record in many areas the Not PR was penned out and written above it "Cause underdetermined" and a few other altered codes, I was shocked at the adadicity of our govertmnet but when I wrote our DAV rep in ME and sent him copies of our records and the altered records from NPRC. Nothing was done about it and the DAV seems not to care.NPRC also sent us a file on another veteran? which I wrote in my letter of appeal to VA thru DAV but again nothing said.

My husband has been rated 10% with 30 due to creative organ loss and his checks were always under 200/mo. In 2003 my husband went to VA rep for increase sc and the female rep made him feel inferior,embarressed as she stated " If you do not tell me how you were injured and your hospitalization in 68 I can not help you so if you refuse to answer my questions you can leave" My husband stated "you have the information in front of you on your computer screen" she refused to listen so he said he had to tell her about the embaressing testicle injury loss and the epididymitis but it was nonveneral " He came hoemand yelled at me " I told you I wanted nothing to due with those butchers they do not care about me" That VA rep gave my service connected husband a nonservice pension tax code 3, and the form 20-5455 line 7, anatomical loss ,00 line 8 lose use 00, line 4. entil code 7L line 6. % compensation 060 and line 16. combined disability , 100. aBOUT FEW YEARS later we got a $40,000 debt to VA as we never had to claim taxes on his 10% and I had to write 3 letters to get the debt released as we did not have 2 pennies to rub together, Also when I was appealing his testicle loss that I felt was incorrectly rated as it should of been 30% and we never got dependent extras the VA told us my husband injury was froma undescended testicle because he had a hernia surgery at age 3 or 4 years old, His entrance exam states normal genitalia and there is no medical evidence of undescended testicles so that is why they rated him 10% in 1968. I am gathering evidence to submit because I am upset at the decades of lies, altered decepted records and I was even told by a Congress women VA rep that my husband had "Misconduct" I was so upset that after reviewing all his records there was no evidence of that so I went to this VA Rep office and confronted him with papers in hand that showed no misconduct then this jerk said" I never told you your husband had misconduct? I hear alot about veterans playing games to get benefits and I am a person that does not play games but will persist if someone has been judjed wrongly and with me it is about the principles and the games I see is the GOVT playing games with the our soldiers who fought for our country and this is how they are paid back,, He is 100% now nut I am not happy with the above wrongs done since 1968 and again 2003. I do not believe the Maine DAV cares about my husband's claim or Vietnam era vets . I want to do a CUE claim and do something about that screw up in 2003. Should I get a lawyer? and who would you recommned? and what do you think about my going further as it is about the principles with me. Cathy

Hello, I am writing at the disgust of the VA's attitude to my husbands LOD injury that occurred in 1968 while in Grafenwoehr, Germany while there with many other units from all over Germany for a month of artillary training or simulating war, my husband refers it as "WAR Games" he told me that the ground shook from the heavy , continual artillary fire, missiles,cannons etc and trying to sleep at night in their tents was almost impossible because of the ground shaking from the shock waves,percussion of the heavy gun fire. During the 3rd week he awoken to extreme pain and his testicle was "size of a grapefruit" he went to the Grafenwoehr Annex on 2 -7-68 which they diagnosed him with Epididymitis,( known as a veneral disease (but his medical records state "nonveneral" ) and they treated him with ice packs, Darvon and bedrest called Epididymitis regimen but the swelling, pain and low grade fever continued so he was sent to the ER @ USAH Munich Germany on 2-21-68 he was diagnosed with DX. 6140: Epididymitis nonveneral vs Dx. 6170: Torsion. , they also did a Chest Xray upon arrival and the Dx reason was Torsion Testis (????) At Munich they did the Epididmyitis regimen for another 16days and the testis had no change ( hard, nontender in one note and soft and swollen in a other note on same days) so on 3-18-68 they decided my husband suffered enough so they performed a R. Orchiectomy and L. Orchioplexy and on the 19th they decided it was Torsion and the pathology report stated " Necrotic, infarcted with severe coagulation of the Testis" He was discharged on 3-17-68 and put on light duty. He told mr he can not remember alot due to the extreme pain he was in but somehow a helicopter is somehow in the picture as he is terrified to ride in one due to his experence in the Army which he told our son not too long ago. He filed for service related C+P prior to his honorable discharge on 10-1-68 and he was discharged on 10-4-68 prior to this and in August 28-68 he had a seperation exam at Ft Riley, Kansas in which my husband stated " Having problems with the surgery I had in Germany" so after his discharge or at this time he asked for help in coping with his loss the VA told him " YOU WILL GET OVER IT" Well he got his SC in 12-68 rated at 10% with 30% due to Creative organ loss but has been paid less than 200/mo. He refused ever to have anything to do with the VA after being rejected after asking for help and he traveled all over the US held a job here and there drank to excess was was court commited to a mental hospital 4 months prior to his reinduction date of 10-5-72. My husband is 10 years older than I and we have 2 children and finally after avoiding the VA I got him to go to increase his SC rate that was in 2003. I could not believe thway the VA treated us " You had children didn't you" " Oh I see you were diagnosed with Epididymitis a Veneral disease" My husband corrected them but they continue to throw it in our face even though the VA medical records state "NONVEN" No one has treated my husband or myself with respect and they ask why are you here after your husband had nothing to do with the VA for years!! I asked about Combat related due to his being in Grafenwoehr doing war games and his medical reports state LOD, I am told I do not know what I am talking about and they are the experts, I also asked about his 51 days inpatient and delayed diagnosis and how he was refused counseling for a loss that has affected his manhood and how it impacted not only his life but our family. Our 2003 appeal is at BVA since August 2009 and the judge has not even opened his file.. I have had several surgeries had to go on disability and we are barely living but the VA could care less. I need to know if there are any other options as I really think there is no help for us.. A disgrace for a veteran who was so proud to serve his country at 18 years old and who was not only mistreated by our govertment but also our citizens as he had eggs thrown at him while in uniform in Chicago and New York...
