Claims Center Screwing Me

Recently i filed a VA claim for benefits for PTSD. Plenty of stressors but, VA states the first time it was denied that 1. They cant find my medical records anywhere. 2. That they cant find the related stressors that im talking about. The thing that really takes the cake is that i wrote a letter to the senator of missouri where im from and he writes me back with a letter that is going to the place in Virginia to help me find my unit records that definitely has the stressors that i need for my claim. I called the VA claims center and asked them if they used the place in Virginia that specializes in getting the stressor information for PTSD claims and they said that they didnt know if they had or not. I called the place in Virginia and they said that they had no such info from the VA claims center in reguards to my claim. So basically they are deciding my claim without any evidence which we all know that they will deny it for sure with no evidence that they wont ask for. The funny thing is that i have nexus from the doctor and the diagnosis and a note from him saying that because of my condition (PTSD) that i cannot work at all; Ive filled out the form for unemployablity with my VA rep and I filed for SSD and SSI which i received SSD already just based on my only current VA records of 6 months. It only took the social security 1 month and a half to deem me disabled with SSD which i didnt even have to go to a doctor from them because they just used my va record and my 5 page stressor letter that i used for my va claim. Anyone know what i should do? I feel like the VA claims is not even looking for things on my case but, just sending me denial letters hoping that i will give up!!!!! Ive even had them call me telling me that its going to be tough to award me a percentage without the facts from the unit on my stressors that i had given them. Like i said the doctor even wrote in my notes that the reason i have PTSD is from the Military cant they read at the VA claims center?

How did the SSA determine the amount of your monthly benefit if they did not have your complete military records?

All time served in the military is part of your wages earned in your lifetime.

I would certainly get in touch with them to see if your military records are still there-they should be at the office where you first filed the claim since it wasn't too long ago.

It took the SSA about 1 and a half months to deem me disabled ssd my ssi has not even been processed yet and they said i would already be receiving back pay for ssd and when i get the other processed a one time lump sum back pay for ssi. They told me that they just used my recent records from going to the VA(about 1yr ago) since they couldnt find any of my other military records. They used the va doctors notes, my stressor letter to the va and the va doctor also wrote me a letter that stated that because of my condition i could not work for at least a year. In the other notes from the doctor he said i have been disabled for 17 years since i got out of the military i guess.....

Any help with this would be much appreciated. Im supposed to receive 779/month for ssd

are you the same Tower Rat there?

Even if not- that too might provide some help with finding your unit-

I think you are going to need buddy statements-

In my blog I have some suggestions on buddy statements-

If you can track down anything at all on the guy who opened up in the classroom-

and can prove you were there then-that sure would help you.

I think you are going to need buddy statements-

If you can track down anything at all on the guy who opened up in the classroom-

and can prove you were there then-that sure would help you.

The unit i was with was the 595th MP CO... not the same tower rat in military.com

I wish that i could find some people that were there when all this happened. I have been looking searching the internet on a daily basis trying to find some of these guys. I even had the guys name that did all that stuff and turned it in to the VA so maybe they could look it up for me but, of course they cant find it or dont want to find it. I also turned the names and ssn of the people that were with me who were injected as well hoping that if just one of them has a claim it will verify my claim also. No such luck yet though. I looked up and talked to some of the people on military.com but, none of those people were there at the time(they were newer and it happened before they got there) It seems like everyone else has dropped off the face of the planet. The Va claims center told me that their deciding my case in the next couple weeks and that its at the ratings table waiting on what they call a ratings specialist to rate it. I know that because their not taking very long that it will probably be a denial. What do you think?

the VA requires solid documentation of stressors more now then ever-

I assume you did check this out too?

One other thing- if you go to the VA web page and click on BVA Appeals and put your unit into a search -(it will take time) but something might turn up that would give you a lead as to what to do next.

If you found any case there with some dates or some sort of verification for the same time and place- and same unit- and same stressor -it could possibly help.
