Med Board Back...now What?

Question

I just recieved my med board back today. I have been found 40% disabled by the Marine Corps and placed on the TDRL. I was told since my rheumatoid arthritis is not stable, I have to go to doc's for the next 5 years before they make my medical retirement permanate. How does this help with my VA case? I heard that I can not accept the VA and the Marine Corps findings it is on or the other. So do I have to give up the medical for my family and exchange privileges if I go with the VA? I still do not know what the VA will rate me at, is it safe to assume I will be found at least 40% disabled? Thank you in advance for any information provided.

You need to do what ever is necessary to preserve what you currently have in terms of compensation. You must assume that the VA will try to minimize your problems as much as possible, in order to justify the usual VA "low ball" rating. 40% is just short of a compensation threshold as I remember. If memory serves, you really might do better to get the 40% rating increased before you start a new hassle with the VA. I doubt that rheumatoid arthritis will drastically improve over time, and likely just get worse.

The VA might just rate you higher depending on the ROM during the exam.

You do not have to give up anything but the comp. If you are authorized med care, exchange etc...... that will all stay the same as you are a chp 61 medical retiree.

On the comp it will be a dollar for dollar exchange.
