Retroactive Payments

I confirmed the info I have gotten from VACO -

Any veteran or widow who was denied a retroactive payment under the Nehmer COurt Order-for any Agent Orange Disability or death should send a 21-4138 with a heading thus:

REQUEST FOR REVIEW OF RETROACTIVE PAYMENT UNDER NEHMER COURT ORDER

AND STIPULATION

Attention :EFCCLL

Tell them why you believe you were denied Retroactive Nehmer payment and enclose copy of any erroneous decision you received which contains the EED the VARO gave youand why it is wrong.Enclose any past denied decision for the same disability whether it was appealed or not.

The statement in the VA Fast letter (only claims denied after Sept 1985) is incorrect.

Widows should state the Date of death of the veteran as well.

Send this with a tracking slip or other proof of mailing to:
