    I have a friend who retired from the local VA in research who served just across the border in Thailand. He also did research so he made frequesnt trips into the RVN. The denied his DMII claim for several years until I looked at his DD214. After I helped him he received a big retro check with an explanatiojn that they had made a gregious error. His RVN service was right there and the RO had not looked at it for several years. The Kicker was this: His specialty was Diabetes research.

  3. Thanks Allan, I sorta thought the va was stallin' Iwill go and get my records or find out my could be destoryed too because of inactive time ... lhv :smile:

    After wating a year and a half for the DRO to get my SSA records, I went to the SSA myself. They wrote me a letter stating my records had been destroyed since my file was inactive for so long. The DRO would have stalled the claim as long as he could using this stall tactic.

    Get those records yourself, or be prepared to have your claim stalled for years.

To All; Thanks for your replys !! - I feel that this is a delay tatic also, I'm going to ck. with SSA about those records and VA's request 4them,( what &when ect.. ) you know come to think of it; VA SHOULD have those already !! They had to see'em to Grant me 40% (back ) then 10% ( maj. depression ),anyway gonna ck. in to it.. TY-lhv :smile:

I hear you Sidney, this was not a phone call.. this was a letter from my VARO telling me what they've done so far.. they say they need a reply within 30 days--- so-- should i wait or respond and say ok get what you gotta get.. or take matters in my own hands,.. get the records myself and cut down on wait time?..lhv :unsure:

    I went through this same mess last year with the AMC. They said that they were waiting on my SSA records

    before they could make a decision. This went on for months. I contacted the SSA and was told that they had

    not received any such request from the VA. I contacted the AMC and told them what SSA said. A few more

    months passed and I contacted the SSA again. They stated that I don't have any SSA records to send to the

    VA. I contacted AMC again with this information and was told that they would still wait on a response from

    the SSA, and not to contact them again concerning this matter.

    I immediately contacted Congresswoman Hagin's office and explained what was happening. This was on a Friday.

    The following Monday received communication from the AMC that they had all the information they needed and

    would make a decision. WTH!!

    This is why I don't believe ANYTHING that I am told by the VA unless I see it in writing. These people will

    tell you anything on the phone.

Hello All, Today I recieved another request from the va for more info, this time from Social Security for my disability medical records,??? they(va) said that they have requested copies of those records and it may take a few months to receive a response..BUT the letter also said that i should send this evidence within 30 days?? now my question is why would they need these records when the have my va medical records and my ssdi decision award letter based on my s/c injury.. plus i don't have those records on hand anyway.. so does anyone know if the local ssd office( regional ) would have these and can i request them too? or wait on the va to gett'em and go from there? Thanks LHV..:smile:

I went by my VSO today to check on my claim...( increase and IU ) found out that it moved up a notch to decsion-rate stage.. so this is a small success I guess.. now I'm worried that they will find some excuse to deny me IU... my best hope for it lies with me being SSDI, which is based solely S/C injury on active duty back in 1991... and i haven't worked since then... so we'll see, I'm hoping for a big success in getting claim won, but not on a big retro...:wink: ... LHV

  10. hello, I'm new here, I'm a 50%sc vet. i have been looking around some-- very nice and informative website.. I do have a question about IU,I have researched some and know that i fall under CFR 38. 416b i think?.. anyway I Have sent in my claim for IU June 2010 and have had a C&P done and sent in add'l records.. (I'm 40% back injury, 10% Maj. Depression.) I have VA and Private medical records.also on the same claim a increase for my 50%.. I receive SSDI for my SC back injury and depression. i was injured on active duty 1991, been getting both SSDI and VA since awarded in 1992.. i have NOT worked since my injury because SSA disabled me then. does anybody think i have a chance on getting IU because i have been unable to secure and/or follow a substantial gainful occupation as a result of SC Disabilities.. Thanks very much..
