  1. The VA has often taken the C&P results as gospel, even when the C&P examiner is only marginally qualified. In some cases, the Examiner is a NP that completed some sort of VA examiner training. IME/IMO doctors should be a board certified specialist in the appropriate area of practice.

    In the past, the BVA has often taken a properly prepaired and written IMO over a C&P by a lesser qualified person.

    In contrast, VAROs have often ignored or attempted to minimize an IMO and used the C&P results in order to assign a lower schedular percentage, or even deny the claim. I have such a claim, and it is in the appeals process. The VARO dismissed the IMO as speculation, even though the specialist is recognized as an expert witness in the subject by the BVA and veteran's court.

I've been lurking around this site and decided to ask how much weight do the raters place on IMEs, I haven't seen allot of statistical data about the success rate of those submitting them on initial claims. I submitted my initial claim with IMEs for all the below contentions, with MRI results, Roms etc. my question is as I read my comp and pen results the VA doctor tried disagreeing with all my diagnosis etc from private doctor, so I'm curious as how this will all play out Contentions: chronic low back pain (New), radiating pain in lower extremities (New), cervical pain (New), radiating pain in upper extremities (New), bilateral shoulders (New), bilateral knee pain (New), ankle pain, bilateral (New), plantar fasciitis, bilateral (New), sleep apnea (New), severe asthma (New), chronic sinusitis (New), gastrointestinal esophageal reflux disease (New), hypertension (New), inguinal hernia, right, residuals (New), fibromyalgia (New), hemorrhoids (New), Pseudofolliculitis barbae (New), tinnitus (New), hearing impairment, bilateral (New), temporomandibular joint (New), severe depression (New), erectile dysfuction (New), kidney stones (New), irritable bowel syndrome (New), voiding dysfunction secondary to enlarged prostate gland (New).

  3. Claim appears to be moving, just checked Ebenefits and its in the preperation for decision phase, I also spoke to someone to someone from the VA 800, number that confirmed my package is now with the rater, in a ready to rate status... Now I'm wondering how much longer...

  4. These Comp and Pens are a joke. I received copies of all mine also, everything I claimed they put least likely as not, and I only did 30 years in the military and have no issues when I joined. I even have IME from personal doctor and the comp and pen docs states he don't agree with my personal doctor findings. It's truly sad how they treat us that spend our time defending our country.

  5. Thanks all for the replies. I'm going to try and stay away from Ebenefits, as I know it's not up to date, it's very confusing and depressing. I will continue reading these boards for info and to see how other Vets are being treated. By the way I submitted my claim through Waco.

  6. Hello all, I've been lurking around this board for about 5 months now and finally decided to join. I served 30 years in the United States Navy and retired the beginning of July.. I submitted my claim in April while on terminal leave, had IME done and had my doctor do QTC/nexus letters on all my contentions. As of the end of August I had done all my comp and pen exams and my claim seemed to be moving along quickly. They VA has everything they could possibly need to rate my claim, however Ebenefits still says status changed, gathering of evidence, evidence is past due, which is a little confusing. I mailed off the letter stating I had nothing else to submit and to decide my claim. Everything I sent in is listed as well as the comp and pen results. So I guess I will just sit back and wait.
