Should I cancel one of the claims I need advice quick..thanks
HI, Okay quick question and I hope I get some quick advice before its too late. Okay so I put in for an increase in my husband's ihd, and his lungs because he's had terrible residuals since he had radiation for lung cancer. We applied for the caregiver program and was approved but the lady told me that his 100% for his lungs was temporary (which I knew) and that I should be trying to get him increased or made P&T so that his overall average would never go below 70%. Did you get a bogus C & P exam?
I have posted this info here many times but it I almost impossible to find under a search- If you get a bogus C & P exam, you can request a better exam. By "Bogus" I mean: Was the examiner, when you googled their name, not qualified to do the type of exam you got? For example a male vet here with a leg disability- maybe PAD, got a negative C & P exam done by a Gynecologist. A few years ago I got a C & P exam ,I think regarding my husband's HBP. and the examiner stated it was an "in person" exam. By then my husband had been dead for over 20 years. C&P exam records access
After waiting many, many months for C&P exams for several disability rating increases and one new disability I went to a third party exam company, QTC Medical Group. Is there any way for me to get the results and notes from their "exams"? I believe there were omissions and errors that has resulted in the VA planning to cut my ratings and benefits in half. They also completely ignored the new disability filing

iu p&t I’m 70% And Temp 100% IU, Should I Fight to be Rated 100%?
I’ll try to keep this as short as possible. About a year and a half ago I was awarded 70% total disabled rating for hearing loss, flexibility of wrist, and PTSD. They gave me IU bc my PTSD prevents me from being employed. I was also awarded Social Security after a long fight. Things have changed since then. I’ve been educating myself on how these things work and unfortunately I have found some new things out recently. My Dr. and I have talked and I have to go to the TBI clinic in my state and be evaluated. IHD exam for increase but examiner ignored what was in the records
Okay my husband is rated as follows: 10% tinnitus, 30% Ischemic heart, 40% hearing loss and 100% temp lung malignancy. He's had that temp 100% for over two years. He's had all kinds of heart issues since the original heart rating to include two stents, a new aortic valve and chronic congestive heart failure, all of which are documented in his VA file. He is a mess and I take care of everything for him. I applied for the caregiver program and have just been approved. Sleep Apnea
Good evening I was diagnosed with sleep apnea by my neurologist. I looked at the rating criteria but am not clear. Do I have to have a sleep study done as well in case I wanted to file a potential claim? Or is the neurologist diagnosis good enough? thanks

Back Exam
Currently 10% for lower lumbar. Going through my VA medical records and found where my VA doctor documented doing a back exam on me in June 2013. The exam results he documented in my medical record would justify increasing me to the 20% rate. Has it been too long to try and do anything with that exam? Put in for an increase and back date to the June 2013 exam? Thanks.

55 Year Old Rule?
I've seen on a couple of websites where it stated that your VA rating percentage is protected and they cannot reduce your rating once you reach 55 years old. Is this true? If so, where can I find this in the VA regulations for verification? Thank you to all who reply.

Upcoming C&P Exam for Nerve Damage due to surgery; What happens in that C&P?
Long story short. 🙂 My left knee is 30% Service connected. During the ACL surgery they nerves across the knee were severed and I have no feeling in the outside of my leg from the knee to the top of the foot/ankle area and around the front near the top of my foot. That area also no longer has hair. The inner muscle on my calf is significantly smaller than the other. I have an up and coming C&P exam with VES. I would like to know what all they do in this exam. Anyone have an idea? I don't think it falls under paralysis of the nerve as I still have function. I don't know if it falls under neuritis or neuralgia? Anyone have an idea?

Requesting C & P Exams
I am not sure how this really works but I was checking the status of my appeal and I noticed this on the right side of my screen. This was on va.gov. I am not sure if it includes all C & P Exams, QTC Exams and LHI Exams or any other medical exams, just wanted to pass it on. You have to click on view details appeal status to get to see the option. It only shows up on the pending appeal page. You can obtain a copy of your claim exam (also known as a compensation and pension, or C&P, exam) by contacting your nearest regional office.

VA Claim Deferred After C&P for IMO and Higher Evaluation?
Hi, new to the forum and thank you in advance if you can provide any insight. I talked to the VA today because I was confused about my claim, they approved part of my claim and deferred the other half of it. I searched a lot of post here and being deferred is normal for the va, but what confused me was why they deferred it. The reason they deferred my TBI was because they wanted a IMO (independent medical opinion) and also flagged my TBI and major depression for higher evaluation and entitlement. C&P for right hand arthritis and pain
Hello fellow vets, I have a c&p exam next week for right hand pain and arthritis. I am currently SC for: 70% amputation of right index and middle fingers, post mortar explosion. 10% Scars right hand 10% osteo stumps with ankylosis of remaining 2 fingers. 20% right shoulder strain 10% right wrist sprain 10% tinnitus 50% ptsd. I am curious about possible pyramid issues, but would arthritis or carpal tunnel be added to my current hand conditons? Va math will have me at 100% if I get another 30%. Any information would be appreciated!

Defense Bill Passage and Bladder Cancer

I already get compensation for bladder cancer for Camp Lejeune Water issue, now that it is added to Agent Orange does it mean that the VA should pay me the difference between Camp Lejeune and 1992 when I retired from the Marine Corps or do I have to re-apply for it for Agent Orange, or will the VA look at at current cases already receiving bladder cancer compensation. 5,10, 20 Rule

The 5, 10, 20 year rules...
Five Year Rule) If you have had the same rating for five or more years, the VA cannot reduce your rating unless your condition has improved on a sustained basis. All the medical evidence, not just the reexamination report, must support the conclusion that your improvement is more than temporary.
Ten Year Rule) The 10 year rule is after 10 years, the service connection is protected from being dropped.
Twenty Year Rule) If your disability has been continuously rated at or above a certain rating level for 20 or more years, the VA cannot reduce your rating unless it finds the rating was based on fraud. This is a very high standard and it's unlikely the rating would get reduced.
If you are 100% for 20 years (Either 100% schedular or 100% TDIU - Total Disability based on Individual Unemployability or IU), you are automatically Permanent & Total (P&T). And, that after 20 years the total disability (100% or IU) is protected from reduction for the remainder of the person's life. "M-21-1-IX.ii.2.1.j. When a P&T Disability Exists"
At 55, P&T (Permanent & Total) or a few other reasons the VBA will not initiate a review. Here is the graphic below for that. However if the Veteran files a new compensation claim or files for an increase, then it is YOU that initiated to possible review.
NOTE: Until a percentage is in place for 10 years, the service connection can be removed. After that, the service connection is protected.

Example for 2020 using the same disability rating
1998 - Initially Service Connected @ 10%
RESULT: Service Connection Protected in 2008
RESULT: 10% Protected from reduction in 2018 (20 years)
2020 - Service Connection Increased @ 30%
RESULT: 30% is Protected from reduction in 2040 (20 years)-

While the BVA has some discretion here, often they "chop up claims". For example, BVA will order SERVICE CONNECTION, and leave it up to the VARO the disability percent and effective date.
I hate that its that way. The board should "render a decision", to include service connection, disability percentage AND effective date, so we dont have to appeal "each" of those issues over then next 15 years on a hamster wheel. -

Finally heard back that I received my 100% Overall rating and a 100% PTSD rating Following my long appeal process!
My question is this, given the fact that my appeal was on the advanced docket and is an “Expedited” appeal, what happens now and how long(ish) is the process from here on out with retro and so forth? I’ve read a million things but nothing with an expedited appeal status.
Anyone deal with this situation before? My jump is from 50 to 100 over the course of 2 years if that helps some. I only am asking because as happy as I am, I would be much happier to pay some of these bills off!-

I told reviewer that I had a bad C&P, and that all I wanted was a fair shake, and she even said, that was what she was all ready viewed for herself. The first C&P don't even reflect my Treatment in the VA PTSD clinic. In my new C&P I was only asked about symptoms, seeing shit, rituals, nightmares, paying bills and about childhood, but didn't ask about details of it.
