  1. Thanks for your replies. Yes Pete I have not been feeling well. Been in and out of hospital. I just want to get through all of this. My anxiety level is at a all time high due to stress. The Judge thinks I lost it giving my lawyer the boot so close to the hearing, but I am not going to let the lawyer or his firm disrespect me any kind of way.

  2. I don't know where to start but here goes. I had my ALJ Hearing and had no Lawyer. The Lawyer I had was neglecting my case no comunication even wrote me not to call them they would call me. even got into a shouting match with Paralegal Unprofessional. Sec Soc try to get in touch with them and they never replied and I ask them not to represent anymore. They withdrew but expect to get payed if I get awarded. I believe if you help that person win their case and you go to the hearing and do paper work yes you deserve to get paid I have no objection about it but

    They did not do anything to help my case and I found that out at my hearing.

    The assistant ask me if I had any new evendence to add to my claim and if I wanted to see my file. I just had that feeling to bring my medical records but anyway my

    file had not been up dated since March 2007 Wow! what was my Lawyer doing? and he has withdraw but still want to get payed for services they are not doing.

    The assistant told me If I wanted to go ahead with the Hearing I had to sign papers saying I understand. I was also told because I brought in new medical records I could ask for a continous so the judge can look at new records one was the VA Rating that was 100% PT that they did not have. The assistant said the judge needs to see this. The Judge gave me a 30 Continous with or without a lawyer.

    He said my case is 3yrs old and he wants to get it over with. I don't think I can

    find a lawyer in time or would take the case because of other Lawyer I had. I really need some advice on how to get through this.

  3. My brother did file SSDI not SSI in Feb 2005. I am sorry I used to think they were the same. He has been denied twice and he thinks he waited to late to receive SSDI. I told him just ask for a hearing and get an attorney. 2001 he was rated by VA AT 50% and was told he did not qualify for Soc Sec. Did Voc Rehab and could not finish. My question is can an attorney straighten this out for him at the hearing and still get SSDI back in 2001?

  4. Please if someone could help us with this We would be very greatful. My brother had to stop working in Janaury of 2001 did not file until Feb 2005 because he was told he was getting an income from VA and could not get SSDI too. His Disablities have gotten worst. He worked up until 2001 and filed 2005. He was last insured on Dec 2003. Does this hurt him or can he file back to 2001? VA was trying to rehab him and it did not work during 2002. They just msde him PT 100 in June.

  5. After waiting 2years for a hearing I finally got one. I am full of Anxiety but I know I need to go and be heard I suffer from Panic Attacks and Major depression that makes my blood Pressure and Heart rate go up. Migraines and Facet joint/Scoliosis to back. I have a lawyer but i still don't feel better. I feel like I am on trial for being sick and asking for disabilty VA FINALLY gave me 100 PT after 3 years of doctors and paper work and waiting. I have not been able to work since 2001 and after that tried to do VOC REHAB which had problems completing. atleast I tried to do it. Does anyone have any advice on how I can get through this.

  6. I noticed that they go by their Doctor C&P and point out negative things that will deny your claim. I am Dealing with Winston-Salem VA.

    I personally don't trust their office. they denied my claim last summer because they said I can work and went just on C&P exam. I have also noticed that when I go to primary Doctor they put down patient is not in pain but prescribing me pain medication not in my record. I have been waiting patiently since and my claim is suppose to be at the raters. I believe they are trying to find ways to deny or hope I give up. I had two new C&Ps since then and the Va wants their Doctors to make a decision on no c-file or whatever they send them. I want to say more about the corruption but I will leave it alone for now. They taught me a good lesson Watch you say GET your records and know the rules and your rights because they really think we are ignorant. Its sad that there is so much corruption to stop our deserving Veterans trying to get their benefits.

  7. Hello Everybody

    I was told my claim was sent to the rating board on March 21 and it can take some time to make a decision. They said it was screen before it went to raters to make sure all my C&P and paper work were there. I call them and the guy was not sure what to say to me. He said it was at the raters being screened and was confirmed on

    May 24. Does that mean that my claim will be pulled again and a request for more C&P or whatever. I talk to VSO and he didn't help either. all he said was claim was confirmed on May 24 with Rating Specialist. I am just confused and concerned.

  8. Hi

    I have Tachycardia that started in Service in 1996 and it was noted in my Service records. I had to open that case up because I am taking Medication for Blood Pressure that is the same for fast heart rate was not acknowledge by VA a (Beta Blocker) which the VA raters Still denied that is for that. I have to take this for the rest of my life. Keep appealing keep the faith I'am not going to accept what they are saying.

    Voc Rehab has to evaluate you using their own criteria. They will actually schedule you for testing and evaluation. If you are not eligible for voc rehab they should consider you for Independelt Living which they would look for something that would make your life better. Usually that would be a computer or some sort of hobby.

    It sounds like you are 100% schedular and not TDIU. I am 100% for Panic Disorder with agoraphobia and major depression.

    I hope that this helps. I think that you should apply for Voc Rehab. You will gain some insight into how other parts of the VA works.

  10. Hi Everyone

    My question is My C&P exam is saying for Axis IV Not Able to Function. Would that be the same as saying in their terms not able to work. It look like they just didn't want to say not able to work. My Civilian Doctor Just put down due to GAF score of 45 and other Service Connections disabilities It precludes her from Function in any capacity as a employee. Do I need to see if he can write something else or will this do?

  11. Before my DAV Rep quit on me he told me he received a nasty letter from VA Winston-Salem VA This was after we filed my reconcideration June 2006. I had requested all my medical records all C& P everything which he did not tell me to do other VETS told me I had a right to see and get all copies VA had, after that his attitude changed. The other Reps there did not want to go into the matter. They just said he quit and be patient and wait out the rating I can never get a correct anwser from VA or DAV. I feel like they are all playing games.

    I open my claim in Oct 2004 and I was denied in May 2006 of no Service medical Records which I had to hunt down and send in. I did the reconcideration and sent in new evidence plus Service Records. My questions are When VA makes their decision will they try to start my claim at May 2006 or Original claim in October 2004. Is it also true that you can request a 1 year from claim if your are filing Unemployment? I have not worked since 2001 due my disabilities

    and I tried to apply for IU in 2001 but VA denied me and I tried to do Voc REHAB during that time. As with work Mental and Physical Disabilities got in the way and I could not finish. I have been in and out of Hospital and don't really no what to do. When they denied me in 2006 VA said evidence did not show I can't substain or gain employment and VA went on a QTC exam saying my Back has improved From last Exam and 40% will remain. I have been diagnosed recently with Osteoarthritis in my Joints and Scoliosis Major Depression with Panic Attacks and HBP. since then and VA Doctor prescribe Cane and tens unit and a bunch of MEDS. I have been seeing a doctor all along. Va said I Improved but it sure does not feel like my back has Improved. It is in my VA medical now. Can VA still hold that QTC Exam against me trying to apply for IU?

  13. Thanks to everyone for their replies. I was already rated 50% Hypertention and low Back W/Scoliosis and Joint Disease. I Had Depression and Anxiety in Medical records when I left service in 2002. I thought I could deal with it and I went to work. Then a year later still seeing VA DOCS I started having bad anxiety with Depression where I did not want to leave the house. I also started noticing hair coming out in the sink I take a bunch of Meds. Metoprolol Tartrate is one I take for high Blood It made my depression worse. Now I am a mess and me trying to work is very difficult. Right now I don't think I can handle doing Vocational Rehab now.
