  1. Greetings

How would my service connected cervical spine be rated?

THERE IS REVERSAL OR NORMAL LORDOTIC CURVATURE OF CERVICAL SPINE WHICH MAY BE RELATED TO MUSCLE SPASM OR TRAUMA. HYPERTROPHIC CHANGES ARE SEEN IN THE CERVICAL SPINE. THERE IS NARROWING OF THE DISC SPACES BETWEEN C3 AND C5 AND POSTERIOR SPUR FORMATION IN MULTIPLE LEVELS. THESE FINDINGS INDICATE SPONDYLOSIS. PERIVERTEBRAL SOFT TISSUES ARE UNREMARKABLE

  2. Greetings!

I've attached a redacted copy of my 26 Jun 2023 VA Claim for my service connected cervical spine condition which denied for an effective early date.  I have some concerns about this VA investigation, evidence, and final decision of my claim.  This review included the October 28, 1999 Detroit Veterans Affairs Medical Center treatment records and concluded that this end-of-service C&P  X-ray only showed findings of spondylosis or degenerative changes, and it was taken three months after my discharged...it was never included in the C&P exam. Please review and let me know what I can do to get this decision Granted.

  3. Greetings! You did very well in achieving your rightful VA disability benefits. The pain killers help but the numbness and pain is still there. I see my VA Primary Care Doctor today and will request a referral to see a foot doctor. Continue to take care of yourself and be strong and courageous.

  4. Greetings! You did very well in achGreetings! I called the 1-800 number and was told VA had received my C&P Exam and will make a decision soon. You are right that the exam wasn't that bad. It would be nice to get a good rating too. Hey, thanks for sharing and I will post my results when I get it.

  5. Greetings and thank you for this information. I'm currently service connected for Upper and Lower Peripheral Neuropathy at 20%. I recently had a C&P for an increase rating because my PN has gotten worst. In addition to examining my upper and lower extremities, this examination concentrated mostly on my feet.  I believe my overall condition has gotten much worst so I'm looking for a higher rating.

  6. Greetings! I was recently approved for cervical spine, service connected, at 10 percent but I haven't received the envelope yet to see what it says. My end of service VA rating was denied in 2000 and four follow on decisions were also denied. Here's my question, I believe the VA made a critical error in deciding my initial cervical spine claim. The claim folder didn't include their X-ray that showed 'neck trauma and spasm and other conditions ' that wasn't mention in their final decision. That information would have changed my rating. Can I submit a CUE?

The software system is set up to automatically make the calculations mentioned by @pacmanx1.  That said it calculates based on the "inputs" it receives - classic GIGO (garbage in, garbage out).  The devil is in the details for all claims.  You should figure out (ask for help here, VSO, etc.) what you were entitled to (monthly, overall, but also each compensation-producing factor) and then do the math yourself.  You can always request a manual audit if you discover any discrepancies.  Congrats and good luck!

Greetings! I did my own calculations and came up with a much higher figure than what the VA deposited (69k) in my bank account. I will do it again...I could have done something wrong. I attached two VA letters explaining everything that they did but the calculations are off. Hopefully, I will get a copy of the DFAS Error Work Sheet Audit soon that will show how far back the audit  went. More to follow...

  8. Greetings

I requested a copy of the DFAS Audit Error Work Sheet a couple weeks ago via FOIA from VA and DFAS.  This report will let me know how far back the audit went and explain what data was captured. More to follow.

  9. Greetings! I received my VA Back Pay Letter yesterday. The VA Error Worksheet Audit only went from 2008 to 2014. It didn't include rating increases from 1999 to 2008 which changed as a result of the Grant decision.  Should those increased ratings been included?

    Best Regards
