  1. I, like many other veterans on the board, have Berta to thank. If she had not welcomed me so graciously after my very first post on here, I'd probably still be in the dark and still seeking help.

Yes, her posts are sometimes lengthy, but, sometimes you can't get a legal education by watching Sesame Street.

When my claim was denied, denied, etc., etc., and I got to looking at it, it was simply amazing. When I kept telling the VA that I was awarded SSDI for the VERY same thing that I was claiming and they kept sending me SOC's and SSOC's, listing every damn little old doctor's statements, every visit I had to the VAMC, EVERYTHING EXCEPT the SSDI AWARD and the SSA's doctors' reports, EVERYTHING THAT WOULD HAVE BACKED UP MY VA CLAIM, LETTER PER LETTER.........then, THEN, I realized what I was REALLY dealing with. Up until then, I actually BELIEVED what my government was telling me.......................but, I digress:

    Anywho, Thanks Berta!

Mr vets claim is the same pattern he also has been on SSdi for PTSD since 03 and they still overlooked that over and over .......and I kept sending that over and over..they didnt list it in the evidence the first time at all..same thing here all these years

  2. BERTA,

I HAVE EMAILED HIM 3X ABOUT THIS-NO REPLY YET HMMM? HE WAS BUSY WITH HIS JUST RELEASED FILM ABOUT INS. FRAUD -CAPITALISM A LOVE STORY- I HAVE ALL HIS PICS. TRY "LOOSE CHANGE" AS A FOLLOW UP TO SICKO-ITS A DOCUMENTARY BY COLLEGE KIDS- MAKES YOU THINK--TAKE CARE MRSVET

WINTER IS COMING HOPE YOU CAN REST AND CATCH UP ON MOVIES ON A COLD DAY

BERTA - SORRY ITS ABOUT HEALTH CARE(CAPITALISM)- MY FINGERS ARE MOVING QUICKER THAN MY BRAIN!!

  3. I was impressed by something yesterday-sort of along these lines-

I finally had the time to watch the Michael Moore movie-"Sicko".

I know parts of this movie were criticized as to his information but when the testimony from the woman who I think was prior doctor for Humana came on -it led to the impression that bonuses were being paid to insurance co directors based on the amount of medical insurance claims they denied. This is almost the same criteria for VA bonuses- in my opinion. If the claim is denied it is considered a finished product and the EP code is taken.

Where the VA gets the idea that claims take an average of 6 months is beyond me.

Then again ,as broncovet said, they can deny in 6 months and if you appeal, it can take years.

I wonder if Moore has ever considered making a movie on the VA claims process.

    BERTA,

  4. I have been diagnosed with PSTD and MDD. I have talked to several Vietnam Era vets who have told me to write a stressor letter and to get buddy letters. I find this very difficult to write, because I have a tough time just trying not to think of the past. Honestly, my life has been a living hell the last 3-4 years. I remember how I used to be, and I look at myself now. I did a complete 180, and now I'm very much a recluse. I don't go see anyone, and I don't want anyone to come and see me. I have pretty much gotten rid of everyone I associated with. I don't go anywhere hardly without carying my weapon. I just literallyfeel vulnerable and naked without it. My mom says I just need to "snap out of it". She constantly tells me there is nothing wrong wth me, an that lots of men have been to Iraq and they seem fine. I don't discuss the past with her or anyone else. I can't. My marriage is constantly teetering on the rocks and I just had to quit working 3 years ago. It got so bad I got to where I could'nt think anymore. I have a c&p physical and psyc exam next month and I have never had the psyc exam before. I am worried to death about saying the wrong thing as I have been told the examiner is looking for a reason to blame it on something else. I don't drink anymore, never used street drugs, never abused. Do I need to take all these letters in there and describe what paticular trauma caused this? There were so many different things I dont think I can pin point it exactly. I know this is alot to write, but I kinda wanted to throw it all out there so you'd have a better idea of whats going on. Yes, there is the sleep deprivation, sever anxiety, startled response, and I have a very short fuse. My gaf scoresthe last couple of years have been in the mid 30's to upper 40's. Nothing over 50. In 2007 and 2007 I was in and out of the hospital withall this, and one doc from Waco said I was bipolar. I disagree because I was not like this before. Any ideas?

I CAN UNDERSTAND YOUR PAIN AS MY HUSBAND IS VIETNAM AS WELL- I WAS TOLD THE MOST IMPORTANT FACTORS IN WRITING THE STRESSORS ARE WHO-WHAT WHERE AND WHEN? HE ALSO HAD A VERY HAD TIME WITH THIS -BUT WE GOT THRU IT 12 YEARS AGO TOGETHER AND ARE STILL WAITING WE ARE AT THE END OF OUR CLAIMS PROCESS AND HAD SOME BAD ADVICE ALONG THE WAY-LISTEN TO THE MODERATORS HERE-THEY GET YOU THRU IT AS THEY HAVE OTHERS-GOOD LUCK TO YOU

  5. Made a call before to check on status of claim-Mrvets claim was remanded 1/7/09 for another CP exam due to a conflict in report from IMO(favorable) and VA CP exam in 07-

    (inconclusive) they scheduled that 8/19/09- the VA PTSD exam stated:SOME IMPORTANT INFO;

CAUSE OF RETIREMENT; medical (psychiatric problem) PTSD

DOES VETERAN MEET DSM-IV STRESSOR CRITERION- yes

    WOULD MEET CRITERIA FACTOR B

IT DOES NOT APPEAR HE MEETS FACTOR C

IT IS THIS WRITERS OPINION THAT THE VETERAN DOES NOT MEET CRITERIA FOR DIAGNOSIS OF PTSD BECAUSE HE DID NOT MEET CRITERIA FOR FACTOR C

IN THE 06 SSOC THE VA STATES THE EVIDENCE SHOWS YOU HAVE BEEN DIAGNOSED WITH PTSD-THE STRESSORS ARE VERIFIED AS WELL

AS I WAS READING HOPPYS POST ABOUT" FISHING " BEFORE , I BELIEVE THEY HAVE A WELL STOCKED POND IN THIS CLAIM!!!

THE CLERK TOLD ME THE CLAIM MADE IT BACK TO THE DRO OCT 1ST(ANOTHER MONTH WENT BY AFTER THE EXAM) PLUS WE ALREADY HAD THE "150 DAY SPECIAL HANDLING "B*****T A YEAR AGO- AND THEY ARE WORKING ON IT-SHE SAID THEY DO GO BACK TO ORIGINAL DATE OF CLAIM AND THAT WILL BE A LARGE SUM OF MONEY-

ANY IDEAS ANYBODY WHAT PILE IT COULD BE ON AT THE DROS OFFICE (THE ATTYS FEEL IT IS 100 % DECISION) ANYBODY ELSE WITH THIS SITUATION BEFORE?

    THANKS MRSVET

  6. The VA claimed they could not finalize my AO claim because they did not have a copy of my DD214. I have been SC since 1971. I used the G.I. Bill. I got a VA home loan. I got VA life insurance. How did I get all these things if they did not have a copy of my DD214. They were stalling. Lucky I had multiple certified copies of my DD214. The DD214 was right in my C-File. How lazy, stupid and incompetent can they get? The VAMC still gets me confused with another vet who has the same first and last name as I do. I get calls about missed appointments. What is wrong with these people?

the attys. gave them everything they need --- TO END THIS WHEEL OF REPEAT........ :)

  7. One of the common tactics is to act like something is missing from the claims file.

It takes time to notice the lack of records, sometimes years.

Time to figure out who should be told about it, vet or rep or both.

More time to actually request the information.

Time lost losing (file 13) the recently submitted paperwork, which is actually a duplicate of records already in the file.

Time lost before the vet, and/or rep, figures out that everything has stalled.

More time asking the RO 'WHY' the claim process has stalled, this could take a long time because another new RO guy has to examine your whole file and realize what was shredded, that the file didn't need in the first place in order to be processed.

However, the new RO guy will bow to the experience of the other RO guy and request the previously unnecessary shredded records again.

In the meantime your RO employees have been advanced and received bonuses for doing their jobs.

You lost your house, car, family, sanity and worst of all your give-a-s#*t.

    Thanks from a grateful nation,

    sledge

Gotta keep copies of everything-been thru this c333p 12 years.......... :)

  8. Spoke to lawyer today -"just checkin up "and they said that the RO requested some papers from them-a copy of the remand and the CP exam reports as of Aug.--(I'm thinking I got them first) :)

he told me that will speed it up as with their last successful claim...Opinions pleez

    Thanks MrsVet

  9. If you are 100% disabled on SS- then you are 100% SC-is it offset as like NSC??

Does real estate tax exmp. apply by state? Thanks MrsVet

and when you are looking for an address in the car why do you always turn down the radio? B)

and if pro is the opposite of con--is progress the opposite of Congress??? B)

  10. They are quite expensive, but if you get the 100 percent P and T award and get the MWR card, The 100 percent disabled Vet gets a free 5 day ticket at WDW and the dependants get a ticket for 99 bucks.

    It expires sometime in december.

    J

Did you ever notice at a small animal park the concession is usually by the lions cage?? B)

That is a good deal- at WDW-is that an ongoing thing?? Been there 3 times years ago...used to l ive nearby St Cloud

  11. We live by the beach, going there makes my troubles go away especially when my granddaughter goes with me, a breath of fresh air B)

Ditto that!! B) when she was here the other day first thing Nana wanna go to the beach-she doesnt realize its 4 hours away-so I put the videos of her on instead and that worked!! B)

  12. Sometimes the best thing a claimant can do is try to get away from it all.

When I had claims in the late 1990s-I started fishing down the road in the river

about an hour a day for brown river trout.

Didnt catch anything big enough to eat- we have to put back trout that doesn't meet EPA requirements. But I never considered the purpose of fishing to catch fish- really just to catch some piece of mind.

I went down there a few weeks after I got my orthopedic inserts to see if they fit into my waders.

Two guys at opposite sides of the fishing bridge were using their cell phones as they waded around the river. They didnt make a single cast the whole time I was there-just yacked on their cell phones- I was ticked-fish can HEAR-

I was disgusted and came home.Usually it is a very quiet spot.I saw an American Eagle alight on a large post near the river one day. I had never seen one in NY before but they have increased their population here.I usually see tyradacktils-near the river- (I really mean those enourmous herons with the big wing span -they look prehistoric).

It helps to clear the brain whenever we can-this claims stuff can drive anyone nuts.

    Berta-

Years ago lived on the Delawarein NY and one time got an eel-it jumped out of the bucket and grabbed my leg-beautiful eagles every night while I watched the sunset and sipped my wine........

  13. Just got back from the shore- needed to get away after the past two hectic years with the claim-everything is looking good -lawyers are very busy now...hahaha!!

just seeing how everythings goin on here!! /Had a tornado there 2nd day-then I got swarmed by 1000's of gulls-felt like Tippi Hedren in the "birds" - and when my grandaughter arrived there --the sunshine shone in!!! <_< shes a beachie like her Nana!

Still waiting to hear about the award.....lawyers are saying it is 100%--will check back and keep ya posted Take care MrsVet

  14. magician2000,

    1) A claimant would want to record an examination, to be able to provide

proof of what was TRUTHFULLY stated and done at the examination.

    2) I consider you to be lucky and fortunate that your RO did get the correct info.

and you feel you got a fair rating.

I feel most here would tend to agree with me that ONLY having a six month delay

in getting a rating would be very welcomed by us.

I am glad you were happy with the claims process and the results you received.

    jmho,

    carlie

If you remember when I wanted to with MRvet.....off she sent me with the VA police :D

  15. mrsvet28,

Sounds good but still go to ROI and get a copy of the C&P.

    jmho,

    carlie

Carlie, got the copy yesterday from the ROI- to sum it all up its says:

Axis 1- PTSD, chronic, depressive disorder NOS,alcohol dependence, history of polysubstance abuse

    Axis 2- defferred

Axis 3 hypertension, bladder calculi, begign hypertrophy of the prostate, hypercholesterolemia, xerossis of the skin, solar dermatitis, chronic low back pain and left leg pain

Axis4 history of combat trauma, multiple chronic health problems

Axis 5 GLOBAL ASSESMENT OF FUNCTIONING

SCORE 50 TIME FRAME: current functioning

comments: Veteran presents with serious/severe symptons, and very significant impairment of his emotional.occupational and social functioning.

then in the medical opinion it states: PTSD due to or result of combat related trauma.

PTSD checklist: SCALE RAW total 85

    DSM_IV PTSD CRITERIA IS MET B<C<and D

    PTSD diagnosis is suggested--

the leg exam said "due to tibial trauma"

So what do you guys think?

    :) Mrsvet
