  1. I apologize you all I believe I worded this incorrectly I chose the option for Evidence submission. Below is the option I chose with new evidence which was a Private physician (orthopedic surgeon retired Lt.Col.

     

    Evidence Submission Reviewed by a Veterans Law Judge: I have additional evidence in support of my appeal that I will submit to the Board with my VA Form 10182 or within the 90 days of the Board's receipt of my VA Form 10182.

    It's strange how the appeals docket date works. I appealed my granted claim in Nov of 2018 and got on the docket in Sept of 2019 When I checked  this am there are still 50,420 appeals ahead of me. On the va.gov tracker it says they are working on claims from June of 2018. If you check BVA Metrics it says current legacy docket date is Sept of 2019.

    CCK is suing the VA, partially because of backlog, needless complexity in process and prioritizing legacy claims.

    I have a question, how do i get access to this tracker for appeals , I dont see anything on VA.GOV or ebenefits. Thanks

  3. I actually did send new evidence with a Nexus opinion from my private Orthopedic surgeon, which was also a Retired Lt. Colonel from the Us Army. I sent it within the 90 day window, the only issue I have is its been since October of 2020 since It was recieved by them and went to Judge is reviewing your appeal in July of 2021, I have called them directly, but they never give information you want to hear besides its on the Judge's desk. 

  4. Finally the long wait is partially over I received my letter today, the judge agreed my sleep apnea began in 2003, only problem is I retired in 2010 and didn’t file until 2013, anyways best news I received in a long time . Thanks for all your support 1 appeal down 1 to go!!

    I like the "GRANTED" part. You need to see something in writing. To you and I, granted would mean you wn your claim. But that doesn't necessarily compute. You still could have to do another C&P to determine the extent of your disability, or to determine your effective date for example. I'd call Peggy at 800-827-1000 and ask the rep what they can tell you.

    Already talked to Peggy, she was very very rude, said she didn't see anything on this appeal. Said she couldn't help me, worst customer service experience ever..

  6. Kind of wondering if anyone has seen this before on my appeal for sleep apnea, I am confused. I had my hearing by virtual and it say the VA law judge is reviewing you claim, under compensation issues it has the following:

    Appeal received March 2020

    Up to date as of March 16, 2021, at 5:25 a.m. ET
