Hi, Berta! I know this is an old thread but I found it seeking out information on Successful Nehmar Cases. In 2007 I was a awarded a 0% service connection for sinusitis due to Iraq burn pit exposer. 13 years later Sinusitis was added to Gulf War Burn Pit Presumptive's and after a C&P two months ago I was awarded a 50% rating this month for the same symptoms I had, documented, and claimed in 2007. Would the retro and effective date fall under the same guidelines as the Nehmar Cases? Thank you for any knowledge and guidance you would be willing to share.

Thank you for your reply. I am indeed confident that I can prove I had the same symptoms and was treated at the VA as well. You have been such a HUGE help, I can’t thank you enough. I just called the number you posted and spoke to the eBenefits people. They are back logged in their mail room but were able to email me a copy of the award letter which indeed is PT. However, the effective date is for August 2021. The next step indeed will be to speak to a law firm. Last question for you... how do I find a law firm that specializes in this type of case?

One more question for you, if you have the time... This past August 2021, sinusitis was added to the presumptive list for burn pits in OIF/OEF veterans. That is the rating that moved me to . I originally filed for a sinusitis rating in 2007 upon discharge from the Army and given a 0% rating at the time and on the enebefits site it is listed as brick factory black smoke exposer. Given the fact that I had a 0% rating given in 2007 and now in 2021 it has been added to the presumptive list... will they back date or retro grade to 2007 and the original claim?

Is the VA still sending out the Big Brown envelopes via the mail with Award Letters? Today is 29 OCT 2021 and I just happened to go onto eBenefits to discover to my complete shock that I was awarded P&T on 1 SEP 2021? I’m extremely confused because I haven’t received notification nor has my monthly service connection changed or retropaid. To add to my confusion, I initiated the claim that placed me over the top on 16 AUG 2021. Would that not mean a 1 AUG 2021 effective date rather than 1 SEP?
