my comp and pension report states i have osteo arthritis since i cant move my arm can i get smc for it since it is related to my injury from the military thats what the comp and pension doctor said

1 more quesVA 101.Md opinions corregating claims to military service in the requested opinion on the Compensation and Pension examinations. Taking into consideration that VA C@P examinations are now computer generated and the questions are actually asked by the RO. Please regard that these questions can be leading to the Doctors and sometimes they even go fishing for a different opinion based upon their own ideas. Then the request for exam asks for a summary as to why the Doctor opied the way he did.
It is best to get a copy of the exam to read the entire exam as well as the Doctors notes.
I used them as a template to my claim and the exams were dead on. I had to fight a little harder as the doc found evidence int he record not even considered by the RO.
Not likely means 0 percent sure
less likely is less than 50 percent sure
At least as likely as not means 50 persent sure ( benefit of doubt rule should kick in)
More likely than not means 75 percent sure.
Was due to means 100 percent sure.
I had 2 more likelys and a was due to and they still tried to jerk it around.
Anyway it was a very favorable exam. I just hope the VA listens to the examiner. They should

More likely than not, means the injury or illness is more than a 50/50 chance of being service connected. This is the statement a rater needs to service connect.
is as likely as not related, would mean its about equal. This would not help you with service connection.
Service connection must be based on a more than likely bases, backed with records and a connection between your claimed issues and service injuries/illnesses.
The mere statement of more likely than not, is not enough to service connect the claim. It must be explained in detail by the Dr why they're for it or against it or the VA will shoot it down.
will an ime help with these less likely least likely issues????

See, my problem is the VA uses what it says are NSC issues as the excuse to withhold education benefits from me. In short, here is what I have been through: I got the anthrax shots shortly before getting out of the Marine Corps. I have had health problems (real health problems, which are verified when lab tests and scans are actually done) ever since getting the anthrax shots. I went to the VA and said I believe my health problems are secondary to my anthrax shots. The VA medical side then began to write derogatory notes about me into my medical record literally because I dared mention the anthrax vaccine. In fact, I have a copy of a memo that the VA wrote about me which literally stated that the VA employees had to start a "psycho-social" profile because I spoke about the anthrax vaccine. Thus I can't get SC for those health problems. The benefits side of the VA, thanks to the medical side, says that I am "too disabled" to go to college because of......."mental illness." Where does the "mental illness" come from? The fact that when I dared mention the anthrax vaccine, the VA would chart into my medical record "delusional thinking."
It is so bad that if I go to the VA medical system and say how depressed I feel about not getting help for school, the VA will chart: "delusions of a persecutory nature." Albeit, they won't bother to state what these delusions are. You see? I am "delusional" for telling the VA about what the VA itself is doing. Thus the benefits side can take those notes and further use those to....withhold education benefits.
I am now stuck in a trap in terms of dealing with the VA. If I even attempt to try to explain anything, no matter how polite I am, that also gets labeled as "anger." What is interesting is that I was literally flagged by the VA for asking for help for my depression. Think I am embellishing, I am not. My Congresswoman's office even found that one out. It was explained to me that I am flagged FOREVER. If I make it into old age and I am in a wheelchair, I will still be flagged by the VA. This proves that it has NOTHING to do with behavior. I have one speeding ticket from 1997 as the only offense of any kind. I have never threatened anybody, nor have I ever harmed anybody. In fact, I have never raised my voice at anybody except for over the phone many years ago. I am by nature a very timid person, especially in person. My step dad who is a disabled veteran actually kicked a VA nurse and was flagged for one year. I, on the other hand, have been told that I am flagged FOREVER.
That said, the VA has referred to things like me writing a WELL-WRITTEN, POLITE letter giving a play-by-play of how the VA is withholding my education benefits as THREATENING. No vulgarity, no profanity. I even signed the letter cordially at the end. The VA didn't even bother to respond to my letter. No. They just call it "threatening." In fact, I chose to correspond through a letter precisely so that the VA would not be able to morph what I said into a "delusion" or something worse. What do they do? They ignore the substance, and call it a "threatening" letter.
I bring all of this up because I think I know what is going on. The VA sees me as a "political" opponent--so-to-speak. I have empirical evidence of VA misfeasance. I have cognitive skills. Just see my website www.NoAnthraxVaccine.net I can write clearly and proficiently. The VA is more concerned about political opponents than they are real security threats. If the VA has engaged in misfeasance against a veteran, the VA must do EVERYTHING in its power to keep that veteran discredited. I guess I should take the VA's behavior as a positive sign that I must have a pretty good case against the VA.

I AGREE WITH YOU PLUS I ALREADY HAVE AN UNDERGRAD DEGREE I'M AGE 50 TO BUT ILL SEE WHAT HAPPENS AFTER MY NEXT RATE DECISION DAV TOLD ME I STILL HAVE TIME ON VOC REHAB CLOCK THEY TELL ME IF VA GRANTS ME 100% SCHEDULAR THEY WILL BACK ME UP IN RE FILING A RE-ENTRY BACK IN TO VOC REHAB. I PITTY HAVING TO SIT IN THAT MISERABLE VOC REHAB COUNSELORS OFFICE THOUGH.

No bonus...and IRS kept our 1200. I hate taxes and interest and penalties...was it worth it to work all these years? Not! Still paying taxes on taxes. Haven't received any $ from IRS since 1973. Been paying them more and more each year. Never claimed dependents during the year either. Sucks.

this case might - I would definitly file the claim-
the "K" award for ED is usually beased on "deformity of penis" meaning the penis bends and prevents intercourse-
but still I agree that this might be a compensable disability that-if due to SC or a SC med- should be SCed.
If you search the BVA under "inability to ejaculate" there are many claims there.
if the medication your on which is prescribed for mood disorder, ptsd, seizures, headaches ect ect ect and it causes ed then can or are you eleigible for smc loss of creative organ
also if the injury alone caused the ed but no bend but you do not have erectile power then can or are you eleigible for smc
loss of creative organ

Even though the VARO will not compensate more than one "mental disorder", remember that a mental disorder may be caused by, or contribute to, or further aggravate MEDICAL CONDITIONS.
Now or in the future, your Mood Disorder and/or your PTSD may contribute to heart conditions, high blood pressure, housebound status, cognative impairment, and the like. The medical condition in this case scenerio would be called a "secondary medical condition" (secondary to your service-connected mental disorder).
It is important to service-connect all medical and mental health conditions that can be linked to your military service, even if the rating is 0% or non-compensatable.

what im worried about is im on iu but im am currently finishing my comp and pension exams for like 6 other documented service injuries 3 of them have ime from doctor bash thst cost me like 5000
if i get my mood disorder increased to 100 or they grant me ptsd for 100 can i still get a schedular 100 on top of ptsd or mood disorder 100% and go back to work with the ptsd or mood 100% plus the other new ratable scs that hopefully will get me to 100% schedular??? not that i wouldn't but if work did become available after i got a schedular 100% if i get a 100% mental rating will that leave me on iu or will i be granted schedular 100%??????
plus dav told me if i get schedular 100% i still have time left on my voc-rehab clock and i should file for re-entry and take advatage of my left over entitlement i would like to get my masters degree thats what the dav nso told me he said if voc rehab
hassles me dav will help me file an appeal
im 50 and im just going with the flow. My old voc-rehab counsler and i hated each other he would show up at my college because he had to fill out paper work when i had to request help for computer classes he use to say to me ya know i really want to kick you out of this program your making me do a lot of paper work
i truly i truly dread the thought of having to walk in to this mans office and file a voc rehab re entry for a masters degree and be interogated by this guy like the first time i went into voc rehab oh he is truly truly a miserable miserable human being and every body in the world knows this guy if he sees me come in his office its gonna be like when dorthy went to see the wizard
of ozz the dav tells me dont worry about him we'll back ya up?? hum i have doubts but any way im trying to make something of myself

well ill wait until after my next rate decision and then look at my voc rehab time clock know i still got bout 2 years left after i got my under grad. If i get denied VOC RE-HAB DAV states i can appeal and appeal, so ill just hold for right now till the next rate decision is in and then go from their. thx

I was just thinking the same thing. They do back ground checks, and it would be a liability issue for them to do this I believe.
well i'm trying to keep moving ahead and where im going i dont know i just keep moving ahead. I dont want to be just hanging out so i keep trying to upgrade do the best i can. At least im trying ya know keep moving kind of thing .

im on iu if i get 100 for depressiion or ptsd will that get me to 100 schedular and if so can i work their after and what if i still have 2 years left on voc rhab entitlement???

As long as the Veteran is 100 percent P and T schedular then I say yes, unless it is for PTSD.
SMC is issued for a serious disability such as loss of use of one hand and foot or for a Vet who has a single 100 percent rating along with another (or combination) that equals 60 percent. SMC S

i talked to dav about this and they said mood disorder is a ratable issue and if they rate it 100 percent then that counts towards a schedular 100% but what about ptsd??
see im at 90 dav says i need 3 more ratable 10 percents or 30 percent or greater to kick the iu and go to schedular 100%
plus i still have 2 more years left on my voc rehab entitlement to and im worried about that to
see i have a bunch of stuuf going on schedular rate then smc cloth allowance i just put in so i dont know whats gonna happen to me rating wise im real nervous right now finishing c and p exams because they did audio and if your hearings improved my viet nam friend told me audio is the one the va proposes to down grade i dont know but im nervous

i already have an under grad degree from voc rehab but i still have about 2 years left on the clock
i am waiting for my new rating decision of schedular 100%
then i am am going to re-file back into voc-rehab and make them pay for a masters degree in criminal justice
so i can go back to work dav tells me even if i have mental rating as long as you get 100% percent schedular you can go back to work and re-apply for voc re-hab
what do you think about this????
thats what the dav tells me i can do in accordance with the regs so thats what i'm working on right now. I wanted to see if other vets have same sort of exepriences.

I think that you are mistaken about 100% Mental as Voc Rehab has approved before. The main thing they look at is if they think the rehab will lead to employment.
I was approved for Voc Rehab in 1998 even though Service Connected at 100%. If they will not give you Voc Rehab don't forget to ask for Independent Living.

but my position is the arthritis is so bad and bone issue is complicated as well i am arguing that the hand arm is no good

i have 2 life insurance policies both for 10,000 for a total of 20,000 when and if i die one is free the other the premiums
come out of my 2 500 disablity
VA insurance tells me even if i get a schedular 100% if i go back to work they will take i think the one for free away is what the kind VA lady said to me
my asbestosis claim oh man yes you have asbestosis but no intastatial lung disease Dr Bash says yes i do and VA radiology said yes you have pleural plaques
NATURALLY THE C AND P DOCTOR SAYS YES YOU HAVE ASBESTOSIS BUT NO YOU DON'T HUM WOW OKAY DONT EVEN GO THEIR IM NOT GOING TO SAY ANYTHING ABOUT THAT SUBJECT

i might add Great Benefit Insurance Comapny in the movie the rainmaker reminds me of the VA VAROS and the way they handle claims for veterans John Voight played Leo Drummond to a T reminds me of the whole VA system the music in the begining is the kind of music you here at most VA hospitals in the foyers or elevators which always seem to be broken or always going down
