  1. Anyone know if I might be able to claim secondary service connection for

    pain disorder  from my primary recurrent low back sprain with lumbar arthritis and lumbar spondylitis.

    denied sc for secondary depression caused by my sc back sprain with chronic pain in 2004. The VA C@P exam mental health, diagnosed veteran to having pain disorder with phycological symptoms of anxiety and depression with low back chronic pain. Denied secondary depression in 2004

    Question is with the VA diagnoses from 2004 would I likely be able to claim secondary  chronic low back pain disorder that was caused by veterans in service low back sprain that is currently rated since 2002?  New VA rules pain as disability veteran is still being treated and medicated for chronic low back pain

    QUESTION,

    the VA PhD wrote this diagnoses from c@p exam and denied me service connection in 2004 for secondary depression caused by my sc low back sprain with chronic pain.

    DIAGNOSES AXIS Pain disorder associated with psychological factors and general medical condition (general medication condition being presumed back injury) Anxiety and depressive symptoms.

    my question with this diagnoses from 2004 c@p exam Can I request my pain disorder be secondary to my sc low back sprain that was awarded in 2002? I continue to have chronic low back pain. and  my 2015 C@p exam for increase, the VA added secondary degenerative arthritis and secondary spondylosis both caused by my sc low back sprain. evidence shows my low back sprain continues to become worse up to 2019.

    If Active duty military medical report records reporting  rectal tear and hemorrhoids from 1991 was not available in c file or medical records for 2009 c@ p exam , only later found in veterans records would the effective date  for leakage and hemorrhoids from 2017 award  date go back to 2009 c@p exam date on a NOD

  4. I might e =be making my question to difficult.

    I will shorten question.  2009 applied for SC for secondary stool incontinence  of my SC low back sprain.  c@p exam hemorrhoids was reported in notes by doctor.  claim denied they said because the did not find any Neuro issues.

    fast forward:  Applied again in 2015 for hemorrhoids and stool incontinence    awarded 20%  hemorrhoids  benefit start date 2015

    60% stool leakage  benefit start date 2017 date of exam

    V A rationel     This is the first time stool incontinence has been diagnosed and related to your hemorrhoids   Your benefit start date is date of your 2017 c@p exam.     Question?   does the 2009 denied claim  help me send nod on effective date  of the leakage?  should it be  2009?  They did not mention the 2009 denied claim ..

  5. found the 2009 decision

    the evidence does not show you have neurological condition.  that is related to sc condition of recurrent sc low back sprain.nor any evidence of this disability during military serfvice.you filed claim for sc for neuro issue secondary to low back sprain

    your service treatment records are neg  for treatment of neuro issues

    examiner stated no medical determined impairment to cause symptoms 

    and the neuropathy could not be aggravated by a negative back evaluation

     

    This was before I found my military treatment records in 2010

    showing treatment for hemorrhoids and tear in retum

Says: Service connection for anal leakage has been established as related to the service connected disability of hemmroids.as an eval of 60 percent is assigned from march 31 2017 This is the date of your c@p exam and the first date from which the evidence of record demonstrates that you have fetal leakage and relates it to a progression of your hemorrhoid condition

  8. I can not locate the denied claim reason dated 2009 c@p exam.

    But i found a few pages of the 2009 c@p exam   showing my request for  my sc low back sprain with  secondary stool incontinence.

    c@p exam reports veteran possible hemorrhoids  from exam and claim denied.  reported on deniel leakage not related to  sc low back sprain.

    FAST FORWARD

    I found several of my old military medical records and  remembered i had rectal tear bleeding in 1991 on active duty.

    I  applied for sc  for hemorrhoids with leakage  In 2015

    2017   awarded   20% hemorrhoids  effective 2015 and leakage fetal   60%  effective date   2017 c@p exam date.

    reasoning shows veterans first known diagnoses of anal leakage was at 2017 c@p exam so V A started my effective date 2017

    In  2009 I did not request service connection for hemorrhoids with secondary anal leakage,  however possible hemorrhoids was noted in c@p exam in 2009.  I only applied for   just anal leakage secondary to my sc low back sprain.  So is it possible to send nod on anal leakage effective date back to 2009 ?  or 2015?   seems like the V A   Does  not want to give me any back pay for the 60% anal leakage, But however they did go back to 2015 for the 20% hemorrhoids. Any legal rules to back pay for leakage from 2009?  anal leakage was requested and the hemorrhoids was noted. If so what would be my argument?

  9.  still trying to understand how they came up with the adjustments listed on payment dates.  60% for secondary leakage  i would of thought would go back at least 6-12 months  considering my CUE reported leakage as problem with the hemoroid condition.

    maybe they  did not make mistake on secondary leakage start date.

    just do not know about the V A law regs.....

    I WAS WRONG ON THE APPLICATION DATE FOR HEMORRHOIDS.  NOT 2016 BUT 2015

    YES I WORK STILL. ATTACHED THE PAYMENT START DATES BUT HAVE NO IDEA HOW THEY CAME UP WITH 5129.00 BACK-PAY.......

  11. I applied for service connected hemorrhoids disability 2016 and got denied 10-2016.  I sent CUE TO LOCAL VA OFFICE

    11-2016  ALONG WITH DISAGREEMENT and wrote veteran should be entitled for hemorrhoids, bleeding and leakage,sent 

     evidence copies I had from active duty doctors In 1990.

     3-31-2017 was sent to C@P exam.

    4-27-2017  Awarded service connection for hemorrhoids and leakage. But the letter I got reports hemorrhoids  award started in 2016

    And Leakage secondary  award starts 3-31-2017  the day I had C@P exam.

    My question is if I sent cue with me stating hemorrhoids with leakage was from active duty, why did they start leakage payments starting 3-31-2017? Should I send letter disagreement?  to DRO ?  or did they follow the rule with back pay?

    2002-VETERAN FILES CLAIM FOR HEARING LOSS AND RINGING IN THE EARS FROM ACTIVE DUTY NOISE EXPOSURE

    2002- VETERAN AWARDED SC FOR TINNITUS, CAUSED BY MILITARY NOISE EXPOSURE

    2008- VETERAN LOST HEARING IN RIGHT EAR AND TINNITUS GETS WORSE ALONG WITH LEFT EAR HEARING LOSS

    2008- VETERAN CLAIMS SECONDARY HEARING LOSS AND MANIERES DISEASE FROM SC TINNITUS

    2009- INDEPENDANT MEDICAL OPINION - REPORTS VETERANS HEARING LOSS AND MENIRES CAUSED BY SC NOISE EXPOSURE

    NEG OPINIONS

    VETERAN AFFAIRS SENDS FILE TO DR AND THE DOCTOR REPORTED ALL HEARING LOSS IS SPONTANIOUS EVENT AND NOT SERVICE CONNECTED

    2009-2013 VETERAN IS TREATED BY PRIVATE ENT DOCTOR, THAT REPORTS THE HISTORY STARTING IN 1990 AND FOWARD SOUNDS CONSISTANT WITH MENIERES DISEASE.

    DR ALSO REPORTS IT IS MUCH MORE LIKELY THE LEFT EAR HEARING LOSS AND TINNITUS IS SERVICE CONNECTED

    AND THE RIGHT EAR MENIERES STABLE

    2009 C@P EXAM DR REPORTS VETERANS MEDICAL FILES SHOW VETERAN HAS LONG TERM MILD HEARING LOSS SHOWN FROM PAST AUDIO EXAMS

    QUESTION IS, DOES THE RATER ONLY COUNT THE V A EVEDENCE OR DOES ONE REPORT OVERRIDE THE OTHER?

    FAR AS I KNOW V A ONLY HAS 2 REPORTS FOR EVEDENCE TO DENY BENEFITS

    WOULD SYMPTOTOLOGY OF SYMPTOMS ALONG WITH THE LAY STATEMENTS WORK FOR THE NEXUS ?

    WOULD REASONABLE DOUBT RULE APPLY TO THIS CLAIM?

    I WOULD THINK MY PRIVATE ENT DOCTOR WOULD HOLD UP MORE WEIGHT WITH ISSUES OF SYMPTOMS FOR MENIERES DISEASE AND BILATERAL HF

    HEARING LOSS. REPORTED.

    AMC WILL PUT FILE TOGEATHER AND RATE CLAIM.......

    DOES THIS EVEDENCE OF THE VETERAN HAVE A CHANCE ?

  13. It is your claim. With your Survuival or existance at steak, You should do these things before you show up for an Exam.

    1: Call the office of the C&P examiner. Ask them if they have your medical information from the Regional Office. If not ask them Why they dont since it is a VA requirement. Tell them you will be bringing yopur own copy with you just in case.

    2: If you dont have a copy and you go and they dont have it, Ask them nicely to reschedule it when they get it.

    The Bottom line is this. Dont go into the exam unprepared. Doing this will cost you time in getting your claim or even result in an unjust medical opinion which causes a boatload of other issues down the road.

    If you dont have a copy of the C File, I urge everyone to get one.

    The better educated you are the better results you will have.

  14. Is there a chart stating what ailments are worth (% Disability)? I'm getting out soon and the doctor tells me I have RLS and Sleep Apnea. He said they are a disabling determination.

    I AM NEW TO THIS BUT I HAVE A QUESTION. I AM RATED AT 10% FOR BI LATERAL TINNITUS

    AND JUST RECENTLY HAVE SUDDEN HEARING LOSS IN ONE EAR. TOTAL LOSS..

    MY DOC SAYS POSSIBLE VIRUS, MY QUESTION IS COULD I REQUEST INCREASE DUE TO RECENT LOSS BECAUSE I AM ALREADY RECIEVING 10% FOR TINNITUS EAR DAMAGE :lol:
