    In other words, if they want, the VA, in theory, could retest you and claim a 10% rating because in their view (subjective view BTW) there is partial relief-i.e. with a CPAP device your respiratory disturbance index (RDI) has been reduced to 15.2 an hour from 41.9-my numbers with a CPAP by the way. No metrics for  measuring "ineffective"  like using a METS assessment or a hearing test for example. I may be over reacting but...

     

    VA cant retest you, but they can have you re-evluated via a sleep test. But, if you are over 5, 10 years for example, what are the chances they do? And if a Doctor Rx you a cpap, thats it, you are on it..

    Still, none of these proposals will have over night.. At least 6 months to a year.

    The OSA rule change is really big. Veteran's compensation would be based on the outcome of the treatment of OSA rather than being prescribed a CPAP. I have a CPAP and I'm rating at 50% but under this new rule I'd probably be at 10% because I get incomplete relief with the CPAP.

    Doesnt the sleep study you take show whether or not the cpap works for you? Or do they have some other way to see if a person is not getting proper treatment?

    I use a cpap, and have for many years. I even mail in my data for them to review etc.. I definitely know when I dont use it, as I feel like I have had no sleep.

    And what is an end organ damage? 

    I am sure it will take some time for them to evaluate and adjust things. Nobody should be affected if already rated, correct?

  3. Hello, A couple years ago , 3/2020, I had heart surgery. Had a 99% block in LDA. Thank God I have three artery's vice two, at least my cardiologist was saying it was a good thing.

    Anyways, I retired in 2012, Oct. I was service connected for blood pressure and of course have been on meds for years, years before even getting out. Cholesterol was high, and they put me on statin, then another med for calcium control. 

    Is the Heart surgery something I should notify my VSO about. Blood pressure hasnt changed any, cholesterol is down due to diet and meds.. 

  4. I can guarantee I dont move around as well as when I was younger. 

    With my granddaughter, I cant hold her very long due to back. I just deal with it..

    I guess the real issue is, I am so busy, I dont have time for much when it comes to medical etc.

    I will ask my VA rep for the ratings I have with codes to see what It states. 

    The only thing I have dealt with at the VA lately is daughter finishing school/college and getting her off the dependent list.

  5. Never thought to file for depression. I dont feel depressed. I work and work to keep my mind off things and to raise my family.. I travel allot to due to my work..

    My ten year point and age 55 are within a month and half, and with my ailments I have, I am just starting to worry after reading about the 5/10/20 rules etc.

    The VA has seen me for knees, back, headaches, several times over the years. All my injuries connected to the service arent getting better, in my reality.. Meds for pain, Over the counter, heating pads. I just deal with it like most people do in the same position. 

    Sleep apnea, if I miss a night with that machine, I feel it..

    Not trying to inflate my ailments, but just starting to think about what to prepare for if here and they need to see me again.. Plenty of MRIs and such on me already. 

  6. Hey, Had a big move and my VA paperwork is lost, approval letters etc. Where can I get copies of the same letter mailed to me?

    I am approaching 55 and want to see what my service connected ratings are, and if they fall into the category of , probably not going to get better, which is written on the AB8 letters.

    Unless someone knows whether or not the service connected issues are not going to get better and possibly be reviewed before 55 (8 months from now), which about a month and half before my 10 year mark..

    Obstructive Sleep Apnea

    cervical spine spondylosis

    osteoarthritis, lumbar spine with degenerative disc disease

    radiculopathy right lower extremity

    tinnitus

    right upper extremity radiculopathy

  7. I filed a claim in July of last year. Va called October to schedule C&P. Unable to due to Out of state. SO, after going back and forth and VA resubmitting for C&P exam, I was able to do exam in Feb 2017. Denied in April. Put in for reconsideration, and with new C&P exam I from June, was upped 10% disability compensation. Ebenefits shows effective date July 1, 2017.

    Is there retro pay involved in this claim,  or is it straight up July 2017 based off of ebenefits showing effective date July.

  8. I have a paperless claimas well and since your C&P exams are done you should have no worries.

    it is at the C&P process where there can be issues one being they ask for your papr claim and since you have no paper it can cause a delay.

    but you are done and now waiting on your decision or additional info either way sounds like your on your way! :)

    I do have a copy of the C&P exam and results. I may ask my DAV rep if they have any paperwork still with them for their records. All I have to do is give them my DD214 next month, then the wait begins. Funny thing is she told me it would be a month, till she saw I was paperless. Then she chuckled and stated, well, only two places do this and the funding for manpower to do these hasnt been adjusted to accomadate. So , it will be a long time...

  9. I am going to be retiring from the USN after 24 years of service. I currently live in Oahu, HI, but will retire in Goose Creek, S Carolina (Charleston area). I have applied for a few disabilities with the DAV, been through my C&Ps already and my paperless claim is in Salt Lake City already. Effective retirement date is Nov1.
