I'm working on a CUE and have hit a brick wall. I need to show that the RO failed to review several specific medical exams that were in my Service Medical Records (SMR) because it's obvious from the percentage I ended up with that they weren't considered. Instead, the RO quoted all but word for word from a MEB that was completed earlier. My problem though is that I don't trust them to just admit that they didn't look at the other records. I've read too many BVA decisions to believe in such fairy tales.
I'm hoping that the version of M21-1 Part 4 that was in use in 2003 will state what they have to include in the "Reasons for Decision" .
If anyone knows where I can find this, or any other reference that will help me, please let me know.
