Va Requirement To Open A Claim On A Disability

Question

I am working on an appeal presently.

I submitted an IMA that found numerous disabilities that were unknown to me and all are related to my service connected disability.

It is my understanding that when the VA receives medical information that indicates or shows additional medical conditions that may be service related that they are required to then open a claim on those items and notify the claiment (me) that they have done so.

I need to know what regulation in the VA claims process states this.

This lengthy discussion ere might help you- do you mean the VA should have inferred some issues you have?

In my opinion any secondary conditions should always be formally claimed to an initial SC disabilty.I would not depend on the VA to recognise anything not formally claimed.

Did the doctor give a full medical rationale as to how they relate to the initial SC?

For this IMO- does it regard a claim request for higher rating or is the specific disability in the IMO not SCed yet?
