My va neurologist wrote me a letter stating: Liam is unemployable due too his back and migrains. Which these are service connected 40.30 each. Will this be enough or will this letter help? 0 FormerMember Posted May 9, 2015 Share Posted May 9, 2015 When you win at the BVA, your claim is sent back to the RO where you filed for rating purposes assuming it was a new or reopened claim. If it was one for increase, the BVA Judge would have that discretion to grant or deny an increased rating and also how high a percentage.From what I read, your appeal has yet to be decided. Once it is, and if you win, then the claim will be sent back (remanded) to the RO for a rating. BVA and VLJs do not award ratings -only VARO raters. If you disagree with the rating, you may appeal that back to the BVA. I use the term remand to mean "sent back to the VARO for rating when you win". As indicated above, the delay once it arrives back will be exasperating. Allow three months for a rating to ensue from the time it returns from the BVA.
