Undiagnosed Genetic Disorder

jacknmickey

Question

Hello,

I have a question. My wife was just now diagnosed with a gene mutation that she has had since birth (diagnosed by a PRIVATE MD, not a VA Doc). There is no cure for the gene mutation, but the treatment is supplement that she will have to take the rest of her life. She has been under the care of the VA Health System since the 1990's, and they have NEVER diagnosed this problem. She could have been receiving treatment years ago that would have increased the quality of her life, and would have perhaps kept her off of various narcotics for her pain. Can we sue the VA for NOT diagnosing and treating a genetic condition?

Sorry bud, remember that you can not sue the VA for mis treatment of a Genetic Condition, caused by Genes not exposure to Military. I have to remember that the VA did not know what to look for. For example I was diagnosed with Crohns after 5 years of active service, so even though I was bleeding and in abdominal discomfort a few years prior, I can not go back, and ask them why I was not treated earlier, they didn't know. Good luck and God Bless
