I don't understand why does VA even cosider the reason for the Social sercity office disission. I mean if my husaband get 60% s/c disabilties and PT unemployabilty and now we called to find the results of the 1151 and they stated the only reason that its being held up is because of the documents from Social security which to let you know was denied and is in a ppeal also.

why does socail sercity not use the VA evaluaton but yet the VA is interested in why they denied his Socail security it states that VA and SS is two diffrent definitions of disabilities. Is there anything I can do and also please help me understand why this is fair. Social sercurity doesn't care if my husband gets VA and doesn't help him to get Socail Security and its diffrent with the VA they want to know why he didn't get social sercurity. This just makes me so angry. What are they going to reveal? they are both two diffrent enities. Help me!

Tammy, it's also possible that VA wants to see whether SocSec classes your husband's back as a deformity or injury. If SS also calls the back a deformity, this would reinforce VA's evaluation. They could then play hardball with confidence.

You know they don't have any doubt that his back was broke at all, they are disbuting his IBS, and because he was able to work for the rail road, for a while. So, why does this matter? I mean the thing is William has never had a workers comp an accident or anything no law suits, no damages to his back. He was good going into the service and a mess coming out. Besides isn't the ruling for social security disablilty diffrent than difinitaion than the VA's definition? Thank you.

Did they propose to reduce a SC rating for his IBS?

Are they waiting for documents from the SSA administration because they have something to do with his IBS?

It seemed that your post meant the Sec 1151 claim is being held up by waiting for these SSA records?

You could try to get a SSA lawyer and for a fee maybe they could help with the SSA matter- also there is a link here somewhere for ALLSUP,Inc.-

these are disability specialists who can assess his SSA potential and then if they take case, there is a fee, -they advertise that their success rate is 97% on SSA claims they accept.

Sec 1151 claims need-

Bonafide medical proof of additional disability

and bonafide medical proof of malpractice or any form of medical negligence that caused the additional disability.

It took almost 4 years for my Sec 1151 claim to succeed.

They already had it for 2 years as Rod filed it and I re-opened.So that is 6 years in all.

I used the VA's own medical evidence in the veterans records to prove malpractice.

They made numerous attempts to deny with VA med opinions.

It involved a lot of study on my part to prove my case and knock down their VA med docs.

Unless you have time to do all that ( I spent lots of time in medical libraries and always had stacks of medical books by my bed. I had a lot on entries to decifer and do not have a medical background) I suggest getting an IMO for Sec 1151 claims.
