Good morning all -

I filed an appeal for a decision re: arthritis. According to my VSO, they failed to do a range of motion test and several other exams as part of the determination. When I received the original rating, they rated me at 40% for knees (without bilateral %), reduced to 20% for a pre-existing condition and 10% for the rest of my joints. In my NOD, I made it clear that I had no pre-existing conditions prior to military service as was NOT noted in my entrance documents (thank God I keep everything). So, I appealed.

This is what my timeline looks like so far. I requested a Video Telecon, but haven't heard anything yet (still too soon, I presume):

07/08/2008 - Local VA Office Decision - RO

02/11/2009 - Notice of Disagreement (NOD) - RO

02/17/2009 - Appeal Pending - BVA

02/23/2010 - Statement of the Case (SOC) - RO

03/24/2010 - Substantive Appeal (Form 9) - RO

12/15/2010 - Certification of Appeal - RO

So, is this good, bad or just plain normal?? Also, can anyone speculate when I could expect notification of a Telecon date? I've emailed my VSO several times, but she hasn't replied. Also, at what point can I call the BVA to find out info?

I also just read Wing's post re: waiver of RO Consideration. Should I file this now?

Appreciate all anyone can offer.

Carlie,

Thanks for the review. I just copied what was on eBenefits as it was shown on the page. This is also my first appeal, so I really don't know what to expect when (only from what I can read in the forums). What I read in your comment is that the RO has certified and transferred the appeal? That's what I'm not clear on: where is the package, and who do I bug about the status....

just,

Have you gotten any letter from the BVA yet saying they have received

your claims file.

You can try giving the BVA a call at (202) 565-5436 and answering a few questions

for them and then asking them if they have received your claims file yet to be under

their jurisdiction.

I'm in hopes that my issues still under remand will

pan out bump me another 70% and make me a member of the 100% club :-)
