  1. Congrat Gam...sounds like you had a well laid out plan with all your chits together..

Yes, I did have all of my ducks in a row as they say. I reluctantly did the claim myself, and was afraid I'd screw it up, but did a lot of research and found my evidence to be indisputable. Got very intimate with 38 CFR......

  2. Well, my journey is over. Just found out that my disability percentage was raised from 30 to 70. I am happy with the outcome, and must say the system worked well for me. My claim took only seven months from start to finish with no lost paperwork or redundancy. Now, I must correct the info the VA has about my service time which will affect CRDP. Working on that now (waiting for the regional office to contact me). I am sure this glitch will be quickly corrected (I hope) as the regional office has both copies of my DD 214. Good luck to all, and I appreciate the help I received from this site!

  3. here is the criteria:

Formula for Rating Intervertebral Disc Syndrome Based on Incapacitating Episodes

With incapacitating episodes having a total duration of at least 6 weeks during the past 12 months 60

With incapacitating episodes having a total duration of at least 4 weeks but less than 6 weeks during the past 12 months 40

With incapacitating episodes having a total duration of at least 2 weeks but less than 4 weeks during the past 12 months 20

With incapacitating episodes having a total duration of at least one week but less than 2 weeks during the past 12 months 10

Note(1): For purposes of evaluations under diagnostic code 5243, an incapacitating episode is a period of acute signs and symptoms due to intervertebral disc syndrome that requires bed rest prescribed by a physician and treatment by a physician.

Note(2): If intervertebral disc syndrome is present in more than one spinal segment, provided that the effects in each spinal segment are clearly distinct, evaluate each segment on the basis of incapacitating episodes or under the General Rating Formula for Diseases and Injuries of the Spine, whichever method results in a higher evaluation for that segment.

Thanks for the reply! I wanted to know when the 12 month clock starts. From the date of the claim, after the C & P exam, or the current calendar year.. As an example; A claim is dated June 2010, there were a total of six weeks of bed rest prescribed from July 2010 to November 2010. No decision has been made on the claim yet, C & P done September 2011, decision to follow sometime within the next 6 weeks. When do they (the VA) count the bed rest period since a decision wont be made until November 2011....

  4. I am new to this forum and I thank those who have educated me greatly!. Had my C&P exam last week and am a bit nervous about this process. Had multiple back injuries while in the Coast Guard which are documented (even on my retirement PE). MRI states multiple herniated disc L1-L5 with annular tears and moderate degenerative disc disease L1-S1. Also have radiculopathy with bilat lower extremity weakness. I have researched that most back claims are rated on ROM, which mine was 40%, but I have documented bed rest for 7 weeks in the past year, and have been out of worked for a total of 5 months the past year. For anyone with experience or similar findings, what would be my likely rating? Am I going to get hosed because of the 40% ROM? I kow this question may be redundant, but I appreciate all responses. Thanks for your support!
