    get rid of sleep VA doc and see outside pulmonary specialist if you can...if data download from smart card shows you are getting worse with continuing compliance with CPAP you are hurting yourself..

    As long as you didnt list a sleep problem on the medical history you filled out as part of your entrance physical you should be ok. You need to get a look at your C-file and the Medical records that are in it. Ensure that no-one else's medical records are in your file(that might be causing them to think you had it prior to enlistment.. Then file a statement in support of claim stating the you have never been diagnosed or afflicted with sleep apnea prior to entry in the armed forces (check you timelines, was sleep apnea even being diagnosed at the time of your entry?). CFR38 3.304 presumption of sound condition, clearly states the presumption of sound condition may only be rebutted with clear and unmistakable evidence of injury or disease prior to service. Then state (if it is true) that no clear and unmistakable evidence of sleep apnea prior to service is present.

    One other question are all your 15 years contigious or did you have a break in service?
