  2. I wouldn't rely on Peggy. "She" has limited information, and, in my experience, there have been times when she was completely wrong. Hell, I even went to the regional office in person and they gave me the wrong information regarding the status of retro pay. I finally went to my service representative (who happens to be located on the same floor as the VARO) and he walked down the hall to talk with the manager of the VARO. It turned out that three months had gone by and no one had even touched my file to process the retro pay. Apparently, at the time, there were a lot of new people who didn't know how to do their jobs and didn't bother to ask, and my service officer also added that many of the people who have been there awhile don't know how to do their jobs either. Go figure. If you have a service officer, ask him/her to personally investigate the status and not to rely on what the VA has in their computer system.

    Almost one month since BVA award and no retro payment yet, went to RO St. Pete, FL, face to face with customer service supervisor, they told me it will take more than 3 months to clear it up and then if you lucky you get it. The whole system is in shakedown now it takes longer than ever to get awarded or payed.

    Actually they haven't even read the award decision yet, never mind the calculations, approvals, singnatures etc. required. Hopefully by the end of the year I expected.

  3. I will be having the same situation and problem as above, award by BVA on July 28th, retroactive payment of effective date, which means have to wait now. Who knows for how long?

    Call Peggy today and she said that the retro payment will take several months to proceed..because of the back load at VARO and decisions, decisions....etc. Disaster again wait times more and more...

  4. based on what i see, you will get back pay from 2008-2012. So the BVA award was an appeal not of the award itself but of the Effective date?

    Why did they deny TDIU?

    Can you not work because of your disabilities? purely not wanting to work or not working wont cut it generally. Have you lost jobs because of it? Have you been awarded SSDI?

    Yes on the appeal with BVA was TDIU and the effective date of original award..Denied TDIU because of non-supportive medical evaluation, can not work because of disabilities since 2007. not eligible for SSDI because of non working continuesly past 10 years, waiting on regular retirement of SS at 62. Have attorney will file an NOD with the BVA prior to going on CAVC appellate court.

  5. Was awarded on December 2012 70% service connected disability upgraded from 10% from 2005 I appeal this to be prior date and did... Now with the new decicion from appeal board the 70% started on Octomber 2008 instead of the 12/2012. So my question is this a retro back pay situation? also I was denied TDIU on the same appeal.

  6. Got the BBE today, TDIU denied from BVA appeals, but got granted this:

    "Quote from BVA order:

    "Entitlement to an initial diasability rating of 70 present for service-connected post concussion syndrome is granted effective October 23, 2008, subject to controling regualtions governing the payment of monetary benefits..""

    Previous I was awarded 70 % on December 18, 2012 is that means will get retro back pay? and when and how this happening? Please help me understand this!

    is the local RO responsible to award retro back payments?
