Va education and monthly pay question
This is about education. I’m 100% totally and permanent disable due to service connected disabilities (PTSD 70%, TBI 10% and others at 10%). So my question is, Can I go to school and finish a 4 year degree, but still get pay the same amount till I get my bachelors to find something better? VA has told me, I can go to school, but VA will treat that as I’m getting better, so within a year my rating MIGHT go down. Which is fine with me, however, is that really true that while I’m doing a 4 year plan degree, my rating will get revised? or do they wait till I finish my degree and then find a job so that then my rating will get revised again? What I’m trying to …

TDIU Effective date
Submitted TDIU Claim in November 2021 after requesting an increase on October 2021. Had a C&P exam in December 2021, where the doctor stated I had trouble maintaining employment since Sep 2021 TDIU Claim was recently approved in June 2023 with an effective date of July 2022 (The day I last worked, this job wasn't SGE either). Should I request a change of my effective date through an HLR? I feel like it should be November 2021 and not July 2022 because of the December 2021 C&P findings.

TDIU effective date and does that date change EED?
I have a question about Effective date of my rating and the 5,10,20 year rule, and maybe even over 55 rule as that applies to me. I was rated 80% March 2005, then September 2013 was granted 80% TDIU P&T (TDIU was for the 70%PTSD MH) I was called by the VA back in 2006 asking if I wanted to apply for TDIU, and at the time I did not know what it was and I was working and told the person it was my therapy to work to "Buzz off". I was let go in 2013 from my job on account of my SC issues and meds I was taking from work. So, how does having TDIU work? Does it start the "Clock" over again or reset it at Sep 2013 TDIU date and now I have a new 20year date?? Erasing t…

TDIU 100 percent cuts age 67 2020
I have just seen a report that TDIU may be terminated at age 67 in the next year. This was proposed some time ago and caused a great deal of stress with veterans affected and was vehemently opposed by Vets groups. Here we go again? Ant input is welcomed and is this possible? What is probability in the opinions of all affected?

TDIU info needed
I’m currently 90 rated and just seeking info on tdiu. Right now my vso is hell bent on me getting up to 100%. I’m getting ready to file gerd, Barrett’s esophagus, hiatial hernia secondary to ptsd. Also I’m filing r/a due to burn pit exposure, and sinusitis. But if they deny then I’m gonna see about tdiu what effective date would the va use for tdiu? I first filed in Nov 2011 for ptsd, filed Nov 2012 due to lower lumbar herniation. I was medically retired from DoD in July 2012, I also was awarded ssdi back dated to July 2012. I did not use anything but my service connected disabilities to obtain both fers medical and ssdi awards. They were at the time (tbi, ptsd, tinn…

Doordash and TDIU
My question is can you be on TDIU and still do Doordash? Next year will be 10 years TDIU for me. I'd like to make some extra money to payoff bills and think about a bigger home for my family. I know there's no way I can work like I used to, I've accepted my limitations, but Doordash would let me work when I want and if I'm hurting, I don't have to do anything. Plus I think it would qualify under both marginal and protected environment work. Honestly, though, the VA terrifies me, and I've heard stories of vets who followed the rules and got screwed anyway. So I'm asking for advice or anyone with experience here. I tried going on the Board of Veterans Appeals …

TDIU from 90%
Has anyone had a successful TDIU claim from 80-90%? if so what was the procedure? Did you have to redo all your C&P exams? Im at 90 with 40% for lower back and 50 for flat feet. Trying to figure out the best way to proceed. Thanks

"Exam request - processing -- No longer needed"
Does anyone know what this means? I took a screenshot of VA.gov > Check your claims and appeals> Status details> Documents filed. Request 5 (request for document) now shows this: Request 5 Exam Request - Processing No longer needed Here's a screenshot. Does anyone know what this means? What does it mean when they say "Exam request Processing -- no longer needed"?

Can I pastor a church???
I'm at 90% (paid at 100%), total & permanant, and unemployable(thru VA, with no reeval scheduled) I also get SS Disability, but now I have an opportunity to pastor a small church. Would I lose everything if I take the position? Or could I take it if I kept the income under the poverty level?

Things are a lot faster now
I did a full claim when I retired about 11 years go. Been 60% and steadily working. After surgery and other back problems, I finally quit procrastinating and filed for an increase due to my deteriorating back. From the time I submitted, which was super easy online, to my C&P exam was two weeks. My most recent MRI showed severe foraminal stenosis on both sides multiple levels. I also added radicupathy to the list. The examiner only measured me bending forward. It did not help that I was having back spasms at the time of the visit. How long is it taking for the VA rater to complete?

TDIU question
I haven't worked for 10 years because of my lumbar spine pain and anxiety, I recently received an increase from 60% to 80% due to additional cervical spine deteriation and radiculopathy. Would I be eligible for TDIU if I haven't worked in such a long time?

100% P&T at 63 Years - Can I submit to have more disabilities service connected?
I am rated at 70/50/40/40/10 (100%) scheduler AND 100% IU. My letter says P&T. My concern is that I have some issues that were dropped by the VA (specifically glaucoma) when they approved my 100%. As a note, I was 50/50/10/10/10 prior to C&P's that qualified me for the current ratings. I had submitted glaucoma with the UI and increase claim, and the glaucoma shows up as claimed but not service connected. I am trying to understand if I should push this to be SC? I am getting great care from the VA for my eyes, and I have to say, everything else. My concern is that I will eventually go blind and there may need to be modifications done to my home for…

TDIU for Dummies
I swear I looked in the pinned post, but I guess I didn't see anything, or it wasn't clear. I am ready to file a claim for TDIU. Currently at 90% combined with 70% of that being PTSD. So, I meet the 70/60/40 rule since one of my ratings is greater than 60%. Also, I have been fired from 2 jobs within the past year, and most recently, it was due to (my thoughts) my PTSD (we have filed a complaint with EEOC for that as well) because I missed too much work for doctors appointments and such. Background out of the way now... Is there a "How to file TDIU for Dummies" guide somewhere around here? Last claim I filed was on ebenefits, but as I understand that has now…

IU permanent after age 70? Where is this confirmed?
Good Evening All, I have not posted in a long while, but I trust the knowledge of the crowd here on Hadit, and especially some of you really well VA versed people. My question is, where does it state - indicate, officially, that when you have been granted IU, after being 70years old or having IU when you become 70 years old, the you become P&T? ptsdlawyers oom - states: "Once the claim of TDIU is granted, many Veterans then wonder whether it’s permanent. While TDIU can be permanent, that isn’t necessarily so. If a Veteran receives TDIU, the VA may determine that their condition has improved sufficiently enough for them to sustain gai…

Super fast TDIU application response
I submitted my TDIU application on Monday with DAV VSO assistance (yesterday, January 31st), and the next day it's already up on VA.gov asking me to upload documents. The timeline shows that a reviewer is already assigned. If any of you know my story about the delays created by my ex-attorney in my want for TDIU, then you will see this is a win for me.

TDIU - buying duplex
I am rated at 90% with TDIU. I also have Social Security Disability I make 150 per month off pension from state I know I am not allowed to earn any substantial income but I am looking at maybe a duplex up to a quadplex (but rare with 3 bedrooms) home. I will live in one of the units VA Home loan program will cover up to quadplex (as least thats what I have been told as long as I do live in one of the units) I am wanting to do this because most of my income comes from the federal government, and if for some reason one or the other or even both stops.. i wil at least have my home being paid for buy renters hopefully (thats the plan) Social…

Appeal or Supplemental Claim
So I got my decision letter a week or so ago. I was denied increase fro 70% PTSD to 100%, due to me not meeting the criteria for 100% according to the CFR. I was also denied TDIU because my former employers would not send back the 21-4192. I had an appointment with my local VA office and they were clueless. They stated that since it was my responsibility to ensure that the 21-4192 were returned, and the employers didn't return, that is why my claim for TDIU was denied. However, So, the question is, what's the better option? Should I appeal the decision, or should I open a supplemental claim? I have also read that if the 21-4192 is not filled out by the employ…

Can TDIU P&T be reduced or new evaluation exams requested?
I just found my benefits summary letter on VA.gov has been updated. My combined schedular rating remains at 80%. My letter says that I will be compensated at the 100% rate due to my TDIU. It goes on to say that I am considered Totally and Permanently disabled. Two questions, actually...does this make me eligible for ALL of the 100% benefits in addition to the compensation?...and does Permanent & Total mean that it's locked in for life with no future exams or possibility of reduction or withdrawal? I understand that it can be revoked if I become substantially and gainfully employed, so we don't need to discuss that aspect. If I remain unemployed for the rest of my life…

TDIU and S-DVI eligibility
I'm confused about the eligibility for premium waivers on the S-DVI. The rules say you may be eligible for no premiums if your disability prevents you from substantially gainful employment. This can only be substantiated by approval of TDIU, but then it contradicts it's self by saying that your Total disability cannot be effective PRIOR to your insurance coverage start date. How the heck can anyone possibly be eligible? Once you've been granted TDIU and they call it "totally disabled", you're disqualified as soon as you qualify. What am I missing here? Is this benefit only for those who started a policy before being rated Totally Disabled? Eligibility Requirements: …

Shorted on 100% TDIU Payments
I am now TDIU P&T and my summary letter says I will be paid at the 100% rate. But it shows my payment will be $3,303.49 instead of the current 100% amount of $3,332.06. Why am I being shorted $28.57 on my monthly payments?

Extra-schedular TDIU Rating
Note: The veteran's combined maximum rating is only 50% based on 38 CFR 4.16 (b) the veteran was awarded TDIU. A total disability rating due to individual unemployability (TDIU) effective from August 26, 2014, is granted. Where a veteran's schedular rating is less than total, a total disability rating may be assigned when the disabled person is, in the judgment of the rating agency, unable to secure or follow a substantially gainful occupation as a result of service-connected disabilities, provided certain requirements are met. Under 38 C.F.R. § 4.16(a), if the veteran has only one such disability, then this disability shall be ratable at 60 percent or more; if…
