I suggest you go over it all carefully.

Can you scan and attach the 1995 decision as to their Reasons ans Bases and the Evidence list?

And the rating sheet, to see if they in fact gave you a NSC rating for the migraines with a diagnosis code and if that was at 10% or more NSC.

Cue is like the Waterfate question....what did they know and when did they know it?

At time of the 1995 decision, was there a documented diagnosis of migraines and did the evidence list show they obtained your SMRs?

Can you give us the BVA Docket number and Citation number?

To all CUE/EED SPECIALIST ( including Berta,Carlie &other Admin) Please help me resubmit an EED/CUE was previously denied.

I've attached decision. In short... in 1991 i developed migraines after a rushed spinal block during a

C-section for the birth of my daughter. The hospital was full & the doctor said they needed the room. Upon leaving service in 1994 I indicated migraines on my exit exam as well as asthma, tinitus & LBP. 6 months later. I received a check for $600 with no explanation. About a week later a letter rating asthma 10% everything else 0%. The letter stated there was NO MEDICAL evidence for migraines. Even though I was prescribed migraine & asthma medication while on active duty.

Fast forward 2006 I requested a C&P for asthma, LBP & Migraines.I now have SEVERE ASTHMA,SARCOIDOSIS OF THE LUNGS & COPD(NEVER SMOKED) 2009 BVA REMANDED the migraine appeal to the VA because I submitted a copy of my medical records from 1991, my entrance physical which stated I didn't have headaches or migraines upon entering service, my exit exam showing I did have migraines & migraine medicine upon exiting service & New & Material evidence from my private doctor that i saw when i was on leave & currently attend. Jan 2011 I was finally awarded 100% Asthma, 40% Back 10% tintus & 30% for Migraines siting a misdiagnosis of TENSION HEADACHES in my medical records in 1991 along with New & Material evidence. It was only back dated to 2006. Jan 2011 I

submitted a NOD requesting migraines are warranted to be rated at 50% and a CUE & EED. August 2014 they were all denied.

PLEASE HELP ME WORD & SUBMITTED A PROPER EED/CUE If I have one. I have come so far I'very been hospitalized several times since my denial and currently have pneumonia. I suggest you send them an IRIS request as to the status of the NOD on the EED.

Tell them what you told us here and ask for a status on the defered issues as well...They might be working on the deferred claims first.

[Dumb Geek Question]

I was so frustrated that my satellitte connection was down since Wednesday , I started to consider Dial up and realized my Acer Tower has no phone plug in thing at all in the areas where the perpheral things are. The long other black thing that holds all the PC,Modem and printer and other plugs for doodads has 2 phone access things but they didnt work.....

then AOL connection icon said I have to add a dialer device.......

did they mean plug the phone line in somewhere,like in the olden days, or is 'dialer device' some sort of program?

I HATE dial up so I am kinda glad it didnt work anyhow.

Maybe with the external modem, I cant use dial up at all........

I guess my question is I have Acer PC circa maybe 2009, am I missing a phone line thing on the front or the back of the Acer tower I have?

My fax worked last time I checked with phone line to printer.

Hi Berta, I've been reading your post for a while. I think you are AWESOME!!! I don't know how to contact you. I Desperately need your help with an Outrageous CUE & EED! I'd love posting my situation in hopes it will assist other unjustly denied Vets. Hope to hear from you soon as time is not on my side.
