Today my private doctor wrote a statement saying that the vet was in an accident while in the military where he sustained injuries to his foot the current status of his foot is more likely than not related
in some way to his prior service and the injury sustained during the service.
can anyone tell me what they think about this statement

Hi everyone I saw my Doctor yesterday and I asked and received a IMO for carpal tunnel and cubital tunnel syndrome secondary to right shoulder injury.
A little history I'm receiving
20% Rt shoulder,
20% Lt shoulder secondary due to over use
10% Lt Biceps due to over use
I would like to know if this is enough to claim service connection for my hand and forearm due to over use ?
Here goes nothing .
Work Status: NOT ABLE to work at present. Estimated to be permanently disabled from this injury to the left shoulder.
He has night symptoms which keep him up at night.
Patient demonstrates weakness and numbness in the left hand and forearm consistent with carpal tunnel and cubital tunnel . This is causing him to be unable to utilize his upper extremity and this is related to overuse and repetitive actions

what if your doctor states that he is 100% certain that it your left leg was secondary to favoring the right leg.
what is the benefit of filing direct service connection or secondary service connection.

Federal law under 38 CFR 3.310 governs these claims, and once granted, the secondary condition is considered a part of the original condition. what does this mean from a lay persons point of view?

(a) General. Except as provided in § 3.300(c), disability which is proximately due to or the result of a service-connected disease or injury shall be service connected. When service connection is thus established for a secondary condition, the secondary condition shall be considered a part of the original condition.
10% rt foot 30% rt shoulder 20% lt shoulder secondary to service connected rt shoulder does this mean that they combined both to equal one service condition. if so how does this apply to Two or more service connected disabilities at least one disability ratable at 40 percent . do you think I might be able to apply for a100% DISABILITY

I was out of work for four months after surgery because of my secondary service connected injury do you think that I might be able to get temporary rating of 100% .

not only did I have this condition in 1998 I received service connection for right shoulder separation is granted with a 0% evaluation assigned.
what should I do next.

in 2002 I filed a claim for left shoulder injury due to overuse I was denied I appeal I lost the appeal.
I tried again in 2012 was denied I appeal again an this time my doctor using all the medical info from 2002 to present Stated.
since 2002 stated that VA treatment records previously indicate that your left shoulder injury was likely due to overuse and your treating orthopedic provider also referenced your previous MRI results and right shoulder history in finding that he was 100 percent certain that it was secondary to favoring the right shoulder. Therefore, the preponderance of evidence indicates that your left rotator cuff tear was due to your service-connect right shoulder disability.
Is it possible to request back pay dating back to 2002.

What we decidedWe determined the following:Service connection for post left shoulder rotator cuff repair (previously denied as left shoulder degenerative
Joint disease and left biceps tenodesis ) is granted with an evaluation of 10 percent effective july 2012. An evaluation of 20 percent is assigned effective may 2015 . This is considered a full grant of benefits sought on appeal.Service connection for surgical scar, left Shoulder, residual of left rotator cuff repair is granted with an evaluation of 0 percent effective july 2012. This is considered a full grant of benefits sought on appeal.Evaluation of right AC separation with arthritis and impingement syndrome(previously under DC 5203), which is currently 20 percent disabling, is continued.Evaluation rt Ac separation with and impingement syndrome, which is currently evaluated 20 percent disabling, is continued from may 2015A separate 10 percent evaluation is assigned for right clavicle deformity effective may 2015.
The separate 20 and 10 percent evaluation assigned for your right shoulder disability rating is combined to a 30 percent disability for your right shoulder and constitute a full grant of benefits sought on appeal.
Your overall or combined rating is 50 percent We do not add the individual percentages of each condition to determine your combined rating.As of 2012 I was 30 percent for my right shoulder and july of 2015 they decided to take 10 percent from my right shoulder. Which is in appeal.
My belief is that my right shoulder should be 40 percent and the left shoulder 20 percent
They clearly took 10 percent from my rt shoulder to prevent the right shoulder from having a 40 percent evaluation On it’s own .
And prevent and application for a claim of 100 percent. Based on one disability being at least 40 percent disabling.I feel that because I won my appeal from 2012 and my right shoulder was at that time 30 percent disabling
That should be able to apply for 100 percent disability. -
Today I received a decision that i've been waiting for four years. and it reads
20% left shoulder
0% surgical scar lf shoulder
20% rt shoulder
10% rt clavicle deformity
10% chronic pain
I,ve been told that this is only 50% total
