  1. Thanks for info all! What does PFD and PDA mean? went for prep for decisions to review of evidence but I didn't get a status update note or anything. Yep still can't get in but a different error message now??? i start pre-law in the fall and I am seriously considering transitioning it to advocacy law because this is crazy. Never asked them for one thing, ever, the redetermined my 10% we didn't request it, but the one time they are jacking me around. Just awful. Not mentioned I got DVT while in service and with the scar, numbness, and associated leg weakness they never rated that either. After this experience I'm done
  2. That helps a lot! It's strange because all of my other updates had a status update too and this one did not, just a change of the completeion dates from 5/1-8/16 to 5/4 to 8/18. there is no more evidence to supple so in Hopi g they are not looking for something that can't be give....
  3. Will the VA request me to do a C&P exam before they approve my temp 100 for the surgery? Had my surgery Dec 2015 for 10% SC right knee do to arthritis, claim went from gathering of evidence to prep for deacons and now back to review of evidence. Just wondering if they have you complete that exam so soon after surgery. thanks!

  5. Good! Well meaning it isn't just me! Really concerned me after the chance back to review of evidence. I still do t understand why it went from gathering of evidence to prep for decision and. Ow to review of evidence? Hoping it's good thing??

  7. My claim has been changing all day! Prep for decision 2 days ago, then to gathering evidence at 12pm, review, to now when I try to log in I get the below message and can't access at all?   8. Well ebenefits has been busy today. We went from prep for decision to review of evidence and now when I attempt to log in I get an error code. Anyone know what this means?   9. Now case when from gathering evidence, to prep for decision and now back to review of evidence. Who can I call to find out why? Does that mean the rater who had felt it wasn't good evidence?
  10. This is why we didn't care when I got out and stayed away from the VA. My TKR was needed I was falling with my then 1yr old son. it wasn't emergency surgery, so that means elective? will that mean I get denied? my 10% did show up today.
  11. Ebenefits shows my payment for school, but my pension payment doesn't show? Are they stopping my payment on 10% til this is decided? 133.17 isn't a lot but it's desperately needed! what do I do?
  12. John Eckert through American Legion. He did get them to back out the info we sent in and out the case back into FDC and to a rater in about 4 days. We actually had went to our county service center to begin with but they didn't tell us anything and should of known that info shouldn't of been uploaded but they did upload, then we find out she's the assistant the actual VSO doesn't meet with vets. So along time ago we selected the St. Paul DAV as rep and we called him about the info and again he fixed in 4 days. we though the criteria was met, his SC is common for TKR (degenerative arthritis). but I don't know if it was considered elective? i don't know if because I did t get any care for 12 years on my knee is going to be a problem? We have 6 kids and medical is expensive. In 2013 found I could go to VA for care and started right away with scope, injections, no improvement.
  13. Now I'm really concerned. It doesn't say mandatory or elective. Just says that SC knee has deteriated to bone on bone due to degenerative arthritis (what I am SC for) and needs complete TKR and then in surgery notes it's noted again the condition of my knee, the bone removed and the length of time.
  14. Do I have to be at 30% before I can add dependents? if it's noted elective will they deny my claim? I was bone on bone, worst knee he's seen in someone my age. How can that be elective?
  15. Ok, does this matter for step-kids? Do I need a copy of my sons transcript for proof of college? Can we claim our grandson? im now scared about what you said on elective? Will that matter? Will it be denied if it says that?
  16. And the VA did all of it on their own no prodding from us. They made that decision to give him 10% in 2014 so we missed that ?
  17. Why would it be considered elective? The doc said that there wasn't anything else they could for treatment to improve his knee other than a TKR. He said that they don't like to do them on someone so young but that again there was nothing else they could do and he needed a TKR. So having it when he did could mean it wasn't mandatory?
  18. Awesome! Thank you so much for responding! I was kind of thinking that since they paid back to 2002 and we only got 8K. We have not added the dependents, we do have 6 kids, 2 not at home, 1 who is in college living at home, 3 kids under 18, and we also have our grandchild that lives with us. Do we add them now, or wait until this is completed? So far I know once this is completed we will file a NOD (have no idea what that is though) to see about getting that 10% increased since he knee has been horrible for years and required TKR, will they back pay for that or should we just leave that alone? Then we have to get the VA doc to start working on his left knee, we already know its bad and needs a TKR but we have to find a way to get that secondary due to having to compensate for his right? Am I correct on this? OMG I have no idea what the heck we are doing and I dont want to mess things up and do them wrong. That is why we are waiting until everything is done so we dont get kicked out of FDC or anything.
  19. I'm a bit confused where to post questions, sorry if this isnt the right place. My husband received severance pay in 2002 when he was honorably discharged. Once discharged he received no compensation or disability pay. In 2014 we received a check from the VA for about 8K and monthly 10% rate, we did not initiate the review nor did we request it. In Dec my husband had a TKR for SC 10% R knee and we have applied for 100% temp disability. I have read that they will recoup severance pay when you receive disability compensation. My questions: Since they started paying him the 10% and he got back pay of only 8K, which for 12 years it would of been around 19K Did they already recoup the severance? Do the attempt to recoup when its only temp 100%? Is there anything we can do to prevent them from taking all of the back pay or all of his monthly amount? P.S Again thank you for all the help.

I'm sorry to ask so many questions!! when separated received seperation pay, then rated at 20% for 6months then 0% for years until they reviewed and redetermined at 10%, (they did the review and increase without us requesting it) then had TKR and applied for 100% temp. currently receive the 10% of 133 a month, wouldnt they have recouped that prior to beginning that 10% payment if indeed they recoup? will the recoup the seperation pay I received? will they take all of the back from me or just a portion? is there arrangements that can be made so it's repaid more affordable? thanks in advance

  22. Ok, a couple more questions! We were able to work with VSO and they got the extra info backed out of the system so the claim is still FDC, they said that "Angie" took the file to "Drew" the rater. How long will this sit with a rater? it was mentioned to file NOD and go for back pay because since he needed a TKR SC should of been higher then 10%. He has since had the TKR (Dec 2015) can we still do this? How would I do that and what evidence would I need? thanks in advance
  23. I dont know how to quote previous replies, sorry! He served from 1998 to 2002, he was a part of Stop Loss after 9/11, I dont know that he would qualify for that program? We are very concerned to start anything else until the temp 100% is determined, we have heard that they will lump everything together and it will take a lot longer. I am hoping that they resolve this soon, it's been open since Jan (yes I know alot of other vets have waiting longer) He should of been higher rated, but once he got out and they declared him 0% we went on with life, the VA then went and upgraded him to 10% all on their own with no prodding from us, like I said we just got a big check in the mail one day and a letter a few days after. He was seperated with degenerative arthritis of the R knee. Once this is resolved, we are seriously going to have to try to get his L knee considered since he's walked with a limp and off gait for the last 14 years. This was an original FDC claim, then they sent that letter we thought we had to response too, concerned that they will now drop this to a standard claim and it will take even longer??? I am hoping that the person we spoke with on Friday at the MN DVA (American Legion) is going to be able to help with that. But we have read on hadit that if you respond it drops you.
  24. No it wasnt elective. His knee was totally shot at 38, the doc said in 20 years he's never seen a knee that bad on someone his age, it took 5 hours and he had to have bone transplanted to complete it. We just found out who the DAV through the American Legion is since the person who filed for us forgot to mention she isnt a VSO, and we found her unhelpful so I started searching the information about the claim and found this person. I'm mostly concerned they will move it to a standard claim since we submitted the form the requested back, how much longer is that going to take if it happens? I'm alittle concerned they will deny his claim, but only because I dont know about this stuff. He was SC 10% for his knee. Thanks
  25. We are new to the site and hoping for some help. My husband left service in 2002 honorably and medically. After he got home and received treatment they determined him at 0%. We went about life although his R knee has always been an issue. In 2013 it finally became to much for him so in the spring he started going back to the VA, they tried to clean it out with a scope, then they tried cortisone injections, but the doc said that his knee was too far gone and that he needed a TKR so at 38 years old he put as long as he could and it was scheduled for Dec 2015. Unknown to us the VA was doing something with his discharge and one day we got a check in the mail for over $8k, and two days later a letter explaining that his R knee has now been rated at 10% do to degenerative joint disease, arthritis and would be receiving compensation at the 10% rate. Great! Now my questions: Will the approve the temp disability for his TKR since he has been determined 10% for arthritis? Is there anything that they could deny it for? Like not getting medical care (we couldnt afford it and didnt know he was VA covered) We filed a FDC only to get paper in the mail that he needed to sign saying his had no additional information, so we signed it and sent it back, then we got flag on ebenefits stating requested information past due. So we contact a VSO, he called us back and told us that they never should of sent that letter since we submitted a FDC, that he was working with a manager and was going to request an informal expedite since its caused his claim to be suspended due to the paper that should never of been sent, the flag about requested information past due has since been removed. Has anyone had experience with this? Will they now drop us to a standard claim because we submitted those additional documents? Has anyone had luck with an financial hardship expedite request?
