  1. How do i proceed with this claim I filed in Nov 2016 which has  been denied without a C&P exam or any communication from the VA. I currently have a VSO but they are completely useless so that is not an option, (when I informed my VSO that i intended to file this claim he said to me you are already rated 70 percent so why rock the boat?).

  2. I have been through 4 different reps at the same office in a years time. Every time I call to speak with someone nobody knows what is going on with claims or appeals. When I finally got the courage to file for PTSD, the rep who i spoke told me that i was already rated at 70% so why did i want to file another claim, then he gave me a list of forms to fill out and ended up having me submit a form to increase all of my current disabilities at the same time I submitted a PTSD claim. i have never had a any proactive communication from the VSO office only reactive to my calls. Yesterday i received a denial letter from the VA for my PTSD claim and have been waiting all morning for a return call from whoever at the office. I feel i can do a better job with out relying on an organization who has receive my stipend and and no longer gives a damn about me or my VA fight. 

  3. Here is what the VA said in regards to my R  Knee. My appeal is for an increase to my original 0% increase to 10%. i want to file an increase due to knee instability, and increased painful ROM, and decreased ROM. (begin PT this week)

    You stated you would not submit a new/increase while there were items on appeal. Is that in general or specific to the appeal in progress? I mean you would not file anything new on the items you have on current appeal? or you would not file anything at all new or otherwise while you have items on appeal? I ask because in currently getting a new FDC together to submit that is not related to my appeal.

  4. My knee is currently rated SC 0% and is under appeal. Originally filed in 2012 granted in 2014 been under appeal since 2015. However my knee has gotten worse and since my last C&P exam in 2013. My questions are should I file on the increase while the original claim is under appeal? And if I did would that hurt my appeal?

     

     

     

  5. Should the highlighted conditions listed below be considered bilateral conditions? If yes can someone smarter than I tell me what my % should be? I have tried figuring out VA Math on paper and cant get he same answer 2 times in a row.

    I sent a request for VR&E on E Benefits in Oct 2015, got a secure message that said my request was submitted on 10/20/2015 and I would be notified soon about the next steps? Is this long a wait usual? if not contact my VSO or?

    Only time I can forsee is if you have a doctor tell (in writing) you that quitting is in the interest of your health because your SC disabilities are having such an adverse affect.

    My advice is do not quit unless you have a doctor advising (in writing) you to do so.

    i have do not intend to quit, but i am a liability to myself the longer i stay in my current position due to my disabilities. i just recently found this website and TDIU so am at the beginning of of research.

  7. Right i understand i need to be unemployed to receive TDIU, but do i have to be unemployed at the time i file? as the primary bread winner, if i quit my job we will be homeless in a  few months or so waiting on the VA to make a decision.

  8. In Oct 2014 i was awarded 10% R Ankle 20% L Ankle 10% L Knee 0% R Knee 10% Lower Back Secondary 10% L  Lower Extremity Nerve damage Secondary 10% R Lower Extremity Nerve damage. And denied  SC for TBI, claimed for concussions on AD, Denied  SC  for Cervical Spine for Degenerative Disc Disease, denied SC for Hearing Loss. I filed an appeal to SC the TBI and Cervical Spine and to increase % on R Knee in Oct 2014 did not appeal hearing loss (my first time dealing with VA). i should have but didn't.

    Last Month (26 May 2016) I receive a SOC denying Knee increase and TBI SC, but nothing about my Cervical Spine. I Call my VSO who informs me that my Cervical Spine has been service connected to 10% back to 2012, with secondary 40% R Arm nerve damage and 30% L Arm Nerve damage but the nerve damage is retroactive to May 2016 the date of my last C&P exam. I filed form 9 within 2 days of receiving SOC, but am still waiting on something from the VA about Cervical Spine so i can NOD the effective dates for R and L Arm Secondary.

    With the Cervical Spine + secondaries being service connected my disability rating increased from 60% to 90%. If i am correct that qualifies me for TDIU? If so do i have to be unemployed to file for TDIU?  And do i have to wait for the VA to notify me in writing of the increase before i file?
