  1. I know I've been asking a lot of questions lately, but before I move out of country, I just want to have loose ends tied up. I was granted non-service pension 100% and housebound after my first VA experience and C&P in 2010. In 2014, my service records and Cfile were examined thoroughly and the doctor wrote like a 5 page reason as to why I was service connected. The importance of this post is that I got SSD in late 2012, and the VA slapped me with a $34,000 debt because I had been paid non service pension since 2010 at a higher rate than I should have with back pay from SSD. Now that I've reviewed my service connected raters notes, and how detailed they were regarding service records, prior treatments before 2010 when I filed for VA benefits, and my CFile, I am beginning to think my first eater did not follow any protocol. As I said, my last eater who granted me service connection documented it well. This is the only sentence in my first claim to the VA from the first C&P examiner. "There was no CFile to review on this patient at the time of exam." Hell, I had like 9 conditions, one of which I'm service connected for now based off of my service records amd prior treatment facilities before the VA. Is this a CUE or just a lazy rater? The report of my C&P listed below are regarding my entitlement to ANY Va rewards, which happened to be non service connected even though my current service connected is listed.
  2. I'm moving out of country on June 20th, that is why the DAV requested an expedite, however now i'm even more confused. I called the 800 VA number to ask if ebenefits updated instantly or daily because my DAV said it was at the final reviewer and they said it was wrong information. SO who the hell has more access to my current status of my claim, the DAV or the 800 VA people? I don't care about waiting, I just don't want to be in Eastern Europe and they throw some curve ball at me without letting me know. Just don't like getting bad information from the DAV or 800 number. Just looking for something accurate, i'm not in a rush at all.
  3. So I filed my claim May 22nd and am OCD about checking ebenefits. I checked every day and they needed nothing from me after I submitted all my info on the 21st of May and my DBQ from my VA psych on May 31st. Called DAV too check status and they said its passed the initial review and in the final hands of the person who goes over the rating before notification. Ebenefits still says preparation for decision. Should I watch it like a hawk all day and through the weekend to see if it changes to preparation for notification or does e benefits not update that fast? How will I know as soon as my rating is completed before I call my DAV back next week as he said to do. Will Ebenefits update any change immediately? Please advise.
  4. Hi all, I just saw an update so fast on my VA claim for unemployable and increase from 70% service connected to either 100% or IU. First thing, is that my status went from "Under Review" to preparation for decision. Second thing, I used to have a C&P exam requested for 2018, and now when I check eBenefits, there are no C&P requests on the list at all. Thirdly, they are also seeking a copy of my service treatment records. Why would they want these since I have already been deemed service-connected at my last C&P in 2014 Does this mean anything at the moment? During the preparation for decision phase, has the VA reviewed my files and determined at this point that I do not need a C&P, because I'm unsure why my 2018 C&P request is gone and I've moved to Preparation for Decision so quickly.
  5. I want to add that I have a clean and clear physical and psychological review (I have my enlistment records) prior to joining. However I attempted suicide in AD, was put on depression medication, and the only thing my examiner from my initial claim in 2010 said is that my record shows I was only feeling a little depressed and was discharged with a personality disorder. I explained to her I was manipulated into accepting that to avoid hazing when my unit came back from deployment the date of my actual scheduled ETS, but she probably didn't notice. And the fact she did not mention or did not see the suicide attempt and anti depressants I was on during AD leads me to believe something in my file is wrong or not recorded.
  6. Yes, they discontinued my pension when I was awarded SC. As far as evmvidence5. My C-File looks pretty open and shut about my consistent inability to maintain long term emotions and mental status. Reviewing my lad C&P exam the examiner stated I had difficulty obtaining and keeping employment, and this was in 2013. Although my VA psych will not fill out a DBQ, her notes on my May 16th visit of 2017 state. That I am unable to maintain employment. So, that being said, I was going to include my last C&P examiners notes, my most recent VA Psychiatrist of 6+ years notes, and ask them to reference my c- File which has more than enough medical evidence to substantiate my claim without needing to gather more. What are your thoughts as far as filling out a statement in support of claim or let my doctors notes showing mental instability prove itself?
  7. Hello, and thank you for reading. I have a question regarding my Veteran's Affairs rating and whether I should pursue a 100% unemployable rating due to mental illness since I received benefits in 2010. In 01/2010 I was awarded 100% permanent and total non-service connected disability from the VA due to a bi-polar disorder. I felt this was unfair as I entered the military in good mental and physical health, and experienced hazing in the military to the level I have developed a schizo-affective disorder. After many years of fighting the VA for service-connected recognition, I was granted a 70% service-connected disability in 2014 due to having a schizo-affective disorder. I cannot work, I have sever anxiety, bi-polar, paranoia, and other issues that just go up and down, regardless of what medication my doctor keeps putting me on. I've been hospitalized for suicide attempts MANY times since 2010. Is it worth hiring a lawyer or VSO to attempt the rating increase, or is it too risky after all of the fighting just for 70% in the event of a decrease because a doctor is having a bad day and just doesn't like me?
