I was recently denied claim increase for respiratory condition. I provided all the evidence listed in the C.F.R . the MS21, and even what the VA stated, they required for increase in a previous claim denial. I really don't feel trustworthy in the VA rapid new appeal claim. I feel is the same VA that denied your claim the first time that going to look at it again. Why would they go against their own decision? Just another diversion.

I have a private attorney for my sleep apnea appeal case. This case is over 3 years old. I'm waiting for the VA to schedule a date for a video board hearing. I don't trust my attorney, He advised me on past occasion not to submit any claims until the appeal is completed. I'm 68 I don't want to wait seven years for the results of a claim that I'm not certain of the results. I have other service connected conditions that I can claim increase. What should I do?

Thanks you Chief. I already have an appeal (3years) pending for sleep Apnea secondary to my respiratory conditions and Rhinitis. Your information is greatly apreciated.

The Department Of Veterans Affair rated me 10% pyramid for all 3 respiratory condition. one of the conditions require low dose of steroid medication to increase to 30% the others requires high dose. My physician recently prescribed low dose for the conditions that required me to obtain the increase. would I need to meet the requirements for all 3 condition in order to qualify for an increase?

What constitute a dominant condition in the VA pyramid rule? How many condition can be a part of that pyramid?
