  1. I’m currently 90 rated and just seeking info on tdiu. Right now my vso is hell bent on me getting up to 100%. I’m getting ready to file gerd, Barrett’s esophagus, hiatial hernia secondary to ptsd. Also I’m filing r/a due to burn pit exposure, and sinusitis. But if they deny then I’m gonna see about tdiu

    what effective date would the va use for tdiu? I first filed in Nov 2011 for ptsd, filed Nov 2012 due to lower lumbar herniation. I was medically retired from DoD in July 2012, I also was awarded ssdi back dated to July 2012. I did not use anything but my service connected disabilities to obtain both fers medical and ssdi awards. They were at the time (tbi, ptsd, tinnitus, sciatica, and l5-s1 herniation). The va had evidence of back problems in my service file and in 06 when I got out and started seeing them. So if I ended up with tdiu. What would the effective date be?

    Now when I file?

    last spine increase?

    last ssdi review

    Nov 2012 for spinal rating 

    july 2012 last day worked for dod, started receiving fers and ssdi 

    also does tdiu deem one eligible for champ va and chapter 35 benefits

  2. Is r/a now a presumptive condition for se Asia. I’m an OIF vet and was finally diagnosed with r/a 2 years ago. I complained about stiff joints for 8 or 9 years.  Finally they had an answer R/A.  My r/a civilian doc says r/a was caused by burn pits and silica. She says she will write a nexus and fill out a dbq. She already knew about the connection of burn pits being associated with cancer and autoimmune disorders. I’m on humira which helps somewhat. But it’s still bad on my fingers, toes, hips, and shoulders.  She also said she’d complete a fibro packet as well. Is this worth pursuing? Or will they shoot it down?

     

  3. I filed some intents on Nov 30,2021. On Nov 29th 2022 I filed my claims. They were on 

    Supplement claim for tbi

    migraines secondary to tbi

    Supplement claim for lumbar discs

    Allergic rhinitis

    My tbi claim was combined with ptsd for an overall rating of 70%. Migraines granted at 30%. RH sciatica 10% and allergic rhinitis 0

    my overall combined rating is 90% effective Jan 5 2023

    On January the 2nd I mailed out my award for fers disability which I received in July 2012. I was retired over my back which was rated 10% then. I also received ssdi dated back to July 2012 which was only claimed as my service connected disabilities.  I sent that as well as about 10 years of evidence from private doctors. A nexus and supported questionare and statement from my civilian doctor stating I was unable to work due to my service connected disabilities. 

    in March I received a letter from the va stating they received my evidence on January 6 2023 and that I needed to make a new claim based on that evidence   But that claim from November was closed fast. Less than 3 weeks after I saw the c&p doctors

    So my question is that, why didn’t the va use the evidence they received 1 day after the claim was closed ?  Would this be a cue claim or something else. It’s still a month out before I see the dav service officer
