  1. i have called the VA Medical Center in Oklahoma City, Ok per the suggestion on Hadit and they informed me they will re-imburse my insurance. Thanks for the guidance and very quick responses from everyone...

  3. kinda of what i thought but they hit my personal insurance for $1000 and without my knowledge.
  4. yes they scheduled the C & P exam down at the VA Medical center
  5. i went to the VA Medical center for my C & P exam on my back and shoulder. i was denied my claim and the VA Medical has billed my private insurance without my permission. Is this how it is supposed to work...
  6. i filed a NOD after the VA disapproved compensation for tinnitus. it took them 18 months to review my extra information and finally received the envelope where i was finally approved and received almost $1900 back pay..i used the NOD form i received here on hadit...all i can say is they will take their sweet time working a NOD...good luck..
  7. is the form for; Notice for Reconsideration different than the Notice of Disagreement? is so if i do a word search of Hadit will it show an example?
  8. please let us know how that works out. I have a service connected right knee and now wear a brace. My left knee is going now and am curious how to word this stuff to get secondary connection
  9. Where does it state they don't have to use it..?? in 38 CFR 4.46 Accurate measurements....i would think accurate and gestimates aren't the same.. Well "less likely than not" provided a denial of all my claims. they stated i didn't provide any other medical information from 1976 to Nov 1978 in which i had seperation exam. i was honorablely discharged in April 1979. Also reads that i failed to show this condition began during you military service and one instance didn't create a chronic condition. Maybe i looked at this wrong, my back problems started after i had surgery on my right knee. The right knee is service connected, so maybe my reasoning should be secondary back pain associated with SC knee. I wear a brace with adverse effect on my normal gait.
  10. i will look for it, it has only been 1 month and i know it takes time. I learned from this forum that i should request the notes to see what they wrote. It is full of measurements of my neck/back/shoulder but none of this was measured. She just used her trained eye to write them down...thought it was strange as the VA defines a tool that must be used but it wasn't and this was accomplished down at the VAMC...
  11. i took a nexus statment from Rentalguy1 (hope that correct) and went to my personal doctor. He checked off that in my medical opinion, the currently medical condition is related to an injury, disease, or event occurring during the veteran's military service. He filled in the present Diagnosis and the injury according to SMR's which i took with me, then signed and dated. this nexus letter wasn't referenced anywhere on my C & P exam notes. She did go and get my c-file because the exam started with, " you're here for a lower back exam." I explained very politely that no it was for the upper back/shoulder/hands...She detailed eveything very well except for the last statement..

After a C & P Exam the last statement on her report was " taking this information into consideration it is the opinion of this examiner that the veteran's current back condition is less likely than not due to his one time complaint of back pain in 1978". i submitted a nexus statment that stated it was according to my doctor. Am i out of the race for winning my claim? She also stated it took 28 years after seperation.. Impression 1. Degenerative joint disease of the cervical and thoracic spine. 2. Bilateral thoracic outlet syndrome. 3. Bilateral shoulder impingement syndrome most symptomatic on the right....
  13. Forgot to add that i had a Nexus statement from my doctor stating connecting this disability to my SMR's...
  14. i had a C & P Exam for my back and shoulders at the VAMC. i requested a copy of the exam and rec'd it in about 10 days. It is very well written with degrees of movement as associated with the exam. The only problem is the nurse Practitioner didn't measure anything. all my measurement are by sight. so to make a long story short....she said, In my opinion this injury is "less than not" due to his one time complaint of back pain in 1978. she also stated it has been 28 years following discharge.. Ironic as to the 28 years as my knee was service connected after 28 years... so am i out of the race with the statement of "less than not"?
