    The way you posted this makes me want to ask questions. Having a VA Shrink diagonse you is good but is not a claim. I've never seen PTSD award unless you had a C & P. Question did you really file a claim & if so what have you done to follow up on it? Most people in my vet group get claim in under year & had C & P after 6 or 7 months. Unless you have a stressor that has to be verified & that's the hold up I dont understand not hearing anything.

    Yep..I filed a claim..your probably right, stresser might be holding thing up. Just thought I would hear something by now. Ill call the iris # soon.. Thanks
  2. Hello, my father had an Agent Orange claim in the works but recently died before decision of believed complication from this. My question is this, If decided will any compensation go to children or would it go to the authority on a will such as the executor to decide or how will this be done. Thanks if anyone knows?

  3. I believe you must have a PTSD C&P exam by a VA examiner, unless they've changed the rules. There is a wealth of information on the site home page related to PTSD claims, read all you can about this mental disorder. Start writing down the questions as they come then post your questions right here on hadit, you will get responses. By the way Welcome Home!

  4. Hello testvet, thought you might know alittle of whats next?

    I went to a va psyche this week, according to them at the end of our session they told me I meet the criteria for ptsd, anxiety, depression from service and possible childhood trauma. I filed a claim, my question is do i go for a c and p or will they go with what the va doctor says?The regional rep said they put it on a fast claim thing, I should fill out some paper work and send back? On meds and have sessions they have scheduled me for months now.. Thanks for any input.

    If your questionaire answers leads more towards a possible diagnosis of PTSD then put in a claim for it. If the Psych Dr gives you this Diagnosis and you have a nexus/contributing factors that signify this is you are one step ahead. So if you have the problems, and the diag, and the Dr wants repeated counseling you have your claim in to see if it warrants a granted % award. Put the claim in especially if your doc is setting you up for an exam for it. Be early rather than late.

  7. Oh, Yes this is the just my VA doctor and no I have not filed a claim. Currently I am sc for airborne injuries in military. I took this test on the myvet web site because of so much of the things I have dealt with for years and it referred me to contact my doctor for further eval. I never knew about this PTSD until the recent exposure of more vets coming out with problems from war. Gues Ill wait and see what my eval says, not sure about claim? Thank you!!

    Is the VBA sending your for a PTSD C&P exam or is this something your VA doctor is doing? Have you filed a claim for PTSD? Unless you file a claim for PTSD this exam is not going to result in a rating for PTSD.

    Not sure but I believe you have 60 days to report change in dependent status. Overpayments are generally deducted from future payments as a means of convenience for everyone. College bound dependents need not reside with you to be claimed, they just simply need be counted as dependent the same way as for financial aid reasons. You technically need not even claim them on your taxes, as many disabled vets are claimed as dependents by a spouse or other family member for tax benefit reasons. At least that is how it is run for GI Bill and Ch. 31, which I have been told is the same regs for disability.

    Best rule to follow is to report changes post haste to avoid any sort of 'penalty' but it is expected that college bound dependents may not reside in the same place as you, thus if they simply move out, i wouldn't sweat it, as long as they continue to attend school at least 3/4 time and earn passing grades you should be good.

  9. Trying to decide if I should send the letter NOD back on two denied claims. Does anyone know if this would effect my current awarded SC claims and bring those claims back to the start again?? Really not sure, Denied claims stated not enough new material evidence so I thought I would get that I believe within 1 year time frame according to letter. One of my denied claims was my neck which is in pain daily along with my back which is more but SC, anytime I would go to the doctor the Meds for my back helped my neck but I guess the VA did not see it that way. My neck was injured also recorded in service during airborne ops. All new to me!!

  10. I have a question if you know, I was denied on 4 other claims for different injuries. If I sent the letter of disagreement for these and had new evidence for the denied claims within the year deadline would this effect my other claims that were SC in the initial claim. Debating on what I should do, thank you for any input!!

    the VA can evaluate a SC veteran pretty much anytime they want to, a new claim allows them to re-evaluate all your issues to see if any have gotten "better" seldom have I ever heard about any vets being found to have gotten worse on this type of review usually the only issues that are found to be worse are the ones that you are asking for a higher percentage for and have the medical records to back up the higher percentage

    they say after 20 years or age 55 they are not supposed to mess with you any more I hope I live long enough to test this theory I have been 100% P&T since Dec 2003 I just turned 55 last month SSD just did a 7 year review and said see you again in 7 more years there is not much hope for cardiac issues to fix themselves and the VA docs won't touch me I am a medicate only patient

    I have never heard of any veterans getting a P&T award on any issue less than 100% award like PTSD, cardiac etc I have seen TDIU P&T which is where the veterans has an issue that does not meet the 1005 level but due to their SC issue they can't work so they are declared Totally Disabled Individual Unemployable

    I would not worry you just got rated you have 3 years maybe even more before they call you in for a new C&P

  11. 3 documented left-right ankle sprains, 2 hyper extentions of left/right knee injuries result in knee condition, lower back-strain DDD from injury. Good luck with your decision!

    GOOD NEWS!!! I'm curious of what injuries you were SC for. I myself have a few injuries from jumping, back in the 70's. I'm still waiting on VA's decision.

    VA EXTENDS ROUTINE FUTURE EXAMINATIONS SCHEDULE BY THREE YEARS VA will now schedule routine future examinations at five-year intervals instead of two-year intervals hoping to cut claims backlog.

    SUBJ: Procedural Change Regarding Routine Future Examinations

    Revision

    This fast letter is revised to comport with 38 Code of Federal Regulations (CFR) § 3.344. We changed the information on handling the results of a routine future examination on page 2.

    Purpose

    At the recent VBA Leadership Workshop, a recommendation was made to modify compensation claims processing procedures to schedule routine future examinations at 5-year intervals instead of 2-year intervals. This fast letter implements this procedural change to aid in the reduction of the rating-related claims inventory.

    Procedure

    This procedural change applies to reexaminations under 38 CFR §3.327 and is effective immediately. Claims should be thoroughly analyzed to determine if a routine future examination is necessary. Once it is determined that a routine future examination is needed, schedule the examination 5 years from the date of the rating decision, with the following exceptions:

    o Prestabilization rating decisions under 38 CFR §3.327(b)(1).

    o Discharge from military service due to a mental disorder caused by traumatic stress under 38 CFR §4.129.

    o Malignancies that require reevaluation 6 months following cessation of treatment for active disease.

    o Any other future examination required under other sections of 38 CFR Part 3 and Part 4.

    38 CFR §3.327 states that reexaminations, including periods of hospital observation, will be requested whenever VA determines there is a need to verify either the continued existence or the current severity of a disability. Reexaminations will be required if it is likely that a disability has improved, or if evidence indicates there has been a material change in a disability or the current rating may be incorrect.

    Routine future examinations established prior to the date of this fast letter (excluding the exceptions listed above) will be automatically rescheduled for 5 years from the date of the rating decision through a software program. Regional offices will be notified when this has been completed. Until notified, all routine future examinations that mature should be advanced to a date 5 years from the date of the rating decision that established the need for the routine future examination.

    Per 38 CFR §3.344(a), when the results of a routine future examination (set at 5 years out) show improvement of a disability that is subject to temporary or episodic improvement, a reduction in evaluation cannot be made based on only one examination, unless all the evidence of record clearly warrants the conclusion that sustained improvement has been demonstrated. The second examination should be scheduled for 18, 24, or 30 months from the date of the new rating decision per 38 CFR §3.344(b). Note that the provisions of 38 CFR §3.344(a) and (b) do not apply to disabilities which have not become stabilized and are likely to improve. Reexaminations showing improvement in these disabilities will warrant reduction in rating.

    Adjudicate and promulgate all routine future examinations under end product 310 and 810 work items.

In my award letter there was a statement made saying "an examination will be scheduled at a future date to evaluate the severity of my service connected DDD l4,l5" I thought that was what the C&P's, other doctors were about? Does anyone know how soon these are scheduled years? months? Or these done periodically and do they effect your rating? If there is already a decision why have they scheduled this? thanks for any input.. Airborne

  14. Yea...:smile: was very stressful waiting but glad mostly how things worked out. I am at 60% ,I read it wrong the first time. Several other denials that I received I might pursue later. Thank you, and good luck with yours too!!

    Now see how easy that was(just joking) What is your current rating- if has changed please update your %. Yours took way to long, take a long look and see where you want to go from here. I now have a VSO doing all my appeals one at a time-good luck!

  15. Thank God, I received my decision letter today!! Mostly all good news..got increase on my back and 2 other sc injuries also I received during jumps in service. I filed in Nov 2009. So thankful!! This website has been a blessing also the Vet who convinced me to pursue my injuries. currently 50% God Bless!!

    The time line does vary. It has to go to 2 more stages after this. After a decision is made it has to be reviewed, then a letter will be sent out. FOr me in AZ once a decision was made-it took one week before I received a letter. Now I am waiting for my retro.. Just be patient a little bit longer. Good luck!
