Agent Orange Guam recent BVA awrd
GBArmy recently posted info in his blog on AO in Guam-I am glad he did, as this situation is still affecting many veterans and probably their survivors as well. Veterans have had a difficult time proving they were exposed to AO on Guam. The fact however that 2 veterans have proven they were exposed to AO on Guam, one quite recently, and there might be more at the BVA site- there are 2,208 BVA decisions there on AO and Guam. https://www.va.gov/vetapp05/files4/0527748.txt What gets me is that VA has been so adamant about NO AO on Guam, however they said that about Thailand, Blue Water ships ,and certain C 123s , and even CON…

My father's claims include new AO presumptives
I have several questions which are at the end of my post, but here is some background information. I got an email from CCK law firm with a link to this Youtube video. It indicates that the National Defense Authorization Act of 2021 was enacted and includes the three new AO presumptives: Bladder Cancer, Hypothyroidism, and Parkinson's-like symptoms (symptoms similar to Parkinson's without actually having a Parkinson's diagnosis). My father served in Vietnam boots on the ground, non-combat, for one year and had a number of ailments arise over time both during and after service. He did file for one musculoskeletal disability in the early 1990s and …

AO vets and Footnote One -Nehmer
There are ten pages of discussion here on Footnote One-iti hard to find the info yu might need so I posted it here: This recent topic here has the main explanation of this part of Nehmer, from email I received from Rick Spataro NVLSP. I will post email addy another lawyer there re: AO claims, when we get a decision that needs their input on the EED. Rick now works on the VBM. https://community.hadit.com/topic/82878-ao-hypertension-award/page/2/

AO Hypertension award
As you all know the recent Agent Orange Defense Dept Bill does not include HBP. I found another recent HBP due to AO award at the BVA- there are more, and some I already posted here- "In the December 2019 examination, the examiner provided a positive nexus for the Veteran’s hypertension. In support, she explained that according to medical literature, the Veteran’s hypertension is more likely due to his exposure to herbicides during service. She cited a news article that reviewed health impacts between Agent Orange exposure and hypertension. The Board finds this opinion to have probative value. While it was somewhat conclusory as it relies on th…

Covert Ops- Vietnam
I have been trying to find more info on the Mote V Will case decision ( Fed Cir) that Tbird posted here today. The veteran had claimed he had been in covert operations in Vietnam. In another fairly similar case the BVA stated: "Furthermore, the Board notes that the Veteran and the appellant has continuously and consistently contended that the Veteran served in Vietnam during a period between 1969 and 1975, where he was exposed to the herbicide agent, Agent Orange; however, the appellant noted that the Veteran’s Vietnam service is not disclosed in his military records due to the top-secret and covert nature of his service. Widow AO Okinawa DIC claim
I saw this article in the new News Section Tbird has put here: https://vanews.wpengine.com/ https://www.erienewsnow.com/story/42619109/widow-of-vietnam-era-veteran-appealing-denial-of-claim-by-va In part: "Veterans Affairs states there’s no record of a cancer diagnosis while Richard served in the 1960s nor is there evidence of exposure to herbicides. “They actually want a photo of him standing by this particular plane that he guarded, however, that’s not possible because he was in a high-secured area,” Mary said. So tying the discovery of Agent Orange barrels to where Richard’s unit was stationed is strategic to the appeal." The VA wants…

Legal Beagles =BVA inconsistency re: HBP and AO ???
I feel like asking the BVA to CUE itself but I dont have a BVA case. There are 3 law judges here . 2 opining on an older NAs report and only one, the third case judge below , knows what he is talking about- as the remand in that third case here calls for the consideration of the 2012 report- Previously the HAS considered a limited and/or suggestive " association of AO to causing HBP- but after the 2010 , they found a "Sufficient" association between AO and HBP In this remand dated 04/28/20 In part it states: "Furthermore, the Board notes that the Veteran has medical trainingIn this remand (dated 04/28/20) "Furthermore, the Board notes t…

Defense Bill Passage and Bladder Cancer
rebabevets posted a question in VA Disability Compensation Benefits Claims Research Forum,
I already get compensation for bladder cancer for Camp Lejeune Water issue, now that it is added to Agent Orange does it mean that the VA should pay me the difference between Camp Lejeune and 1992 when I retired from the Marine Corps or do I have to re-apply for it for Agent Orange, or will the VA look at at current cases already receiving bladder cancer compensation. I’m considered 100% Disabled Permanently-

5,10, 20 Rule
Ddsr posted a question in VA Disability Compensation Benefits Claims Research Forum,
The 5, 10, 20 year rules...
Five Year Rule) If you have had the same rating for five or more years, the VA cannot reduce your rating unless your condition has improved on a sustained basis. All the medical evidence, not just the reexamination report, must support the conclusion that your improvement is more than temporary.
Ten Year Rule) The 10 year rule is after 10 years, the service connection is protected from being dropped.
Twenty Year Rule) If your disability has been continuously rated at or above a certain rating level for 20 or more years, the VA cannot reduce your rating unless it finds the rating was based on fraud. This is a very high standard and it's unlikely the rating would get reduced.
If you are 100% for 20 years (Either 100% schedular or 100% TDIU - Total Disability based on Individual Unemployability or IU), you are automatically Permanent & Total (P&T). And, that after 20 years the total disability (100% or IU) is protected from reduction for the remainder of the person's life. "M-21-1-IX.ii.2.1.j. When a P&T Disability Exists"
At 55, P&T (Permanent & Total) or a few other reasons the VBA will not initiate a review. Here is the graphic below for that. However if the Veteran files a new compensation claim or files for an increase, then it is YOU that initiated to possible review.
NOTE: Until a percentage is in place for 10 years, the service connection can be removed. After that, the service connection is protected.
------
Example for 2020 using the same disability rating
1998 - Initially Service Connected @ 10%
RESULT: Service Connection Protected in 2008
RESULT: 10% Protected from reduction in 2018 (20 years)
2020 - Service Connection Increased @ 30%
RESULT: 30% is Protected from reduction in 2040 (20 years)-

Post in New BVA Grants
broncovet posted an answer to a question,
While the BVA has some discretion here, often they "chop up claims". For example, BVA will order SERVICE CONNECTION, and leave it up to the VARO the disability percent and effective date.
I hate that its that way. The board should "render a decision", to include service connection, disability percentage AND effective date, so we dont have to appeal "each" of those issues over then next 15 years on a hamster wheel. -

Finally Won...NOW WHAT?
Ztmiller8 posted a question in Appealing Your Veterans Compensation Disability Claims NOD, DRO, BVA, USCAVC,
Finally heard back that I received my 100% Overall rating and a 100% PTSD rating Following my long appeal process!
My question is this, given the fact that my appeal was on the advanced docket and is an “Expedited” appeal, what happens now and how long(ish) is the process from here on out with retro and so forth? I’ve read a million things but nothing with an expedited appeal status.
Anyone deal with this situation before? My jump is from 50 to 100 over the course of 2 years if that helps some. I only am asking because as happy as I am, I would be much happier to pay some of these bills off!-

Post in Higher level review
Joey Ross posted an answer to a question,
I told reviewer that I had a bad C&P, and that all I wanted was a fair shake, and she even said, that was what she was all ready viewed for herself. The first C&P don't even reflect my Treatment in the VA PTSD clinic. In my new C&P I was only asked about symptoms, seeing shit, rituals, nightmares, paying bills and about childhood, but didn't ask about details of it. Just about twenty question, and nothing about stressor,Picked By
