Hello again, good folks, All of my claims are said to be rated, So im just waiting on the mail, I couldnt get any info about the the ratings because my VA REP was out of the office today, But another VA REP looked up my file and said a decision had been made and he could not tell me the decision because he could not pull it up on the computer, I called the 800 # and asked them what my curent rating was, They replied that it was curently AT 70%, they also said that they had made a decision on my claims, EBENIFITS says decision phase, So im thinking three out of three cant be wrong, then SECOND THOUGHT im dealing with the VA, Also I went to my regional office to apply for VOC REHAB, They said that they could not help me because I am unemployable with all my disabilities, I guess this was a somewhat of a reality check for me because im so use to working. I also received a letter from The VA today showing that they received my written disagreement, (NOD) for there previous rating for RAYNAUDS, I will wait until I get my rating decisions back before I fill out and return the DISAGREEMENT RESOLUTION ELECTION FORM to the VA, Because they might have already granted my IU.

HELLO, CARLIE AND ALL THE WONDERFUL VETS OUT THERE, As far as the reason for denial of my claim for RAYNAUD'S PHENOMENON I had a bad C&P examiner, There were no test done, the va examiner just looked at my records ask me a few questions, And did not put what I said on paper during the exam, Some of the questions that was ask were. Are there effects of the problem on the following daily activities? NO (i said yes) Is exercise or exertion precluded by the condiction? NO, (I said yes) ECT ECT ECT BS. ALSO the examiner stated, IN MY OPINION IS THAT IT IS NOT SECONDARY TO HIS DLE. RAYNAUD'S PHENOMENON MAY BE ASSOCIATED WITH LUPUS BUT IS NOT CAUSED BY IT. MY NEW EVEIDENCE OF SUPPORT, Will be what I pull off the internate, Like the va training letters, and the research done by National Heart Lung and Blood Institute, ECT ECT ECT. (THANKS FOR THE HELP EVERONE). ALSO a copy of a letter that my VA doctor gave me in support of my claim, That states Discord Lupus is but one category of skin lessions that can occur in patient with lupus. There is some overlap. Patients with Discord lupus have a predominance of symptoms that do not involve internal organs. Discord Lupus can be a slowly progressive diease with joint sysptoms such as pain, stiffness and swelling. Raynaud's phenomenon is also in patients with lupus. IT IS AS LIKELY AS NOT THAT RAYNAULD'S PHENOMENON AND HIS JOINT PAIN TENDERNESS ECT ECT ECT ARE DUE TO HIS SERVICE CONNECTED CONDICTION OF DISCORD LUPUS. HIS DISABILITY SCORES OF 1.0/10-3.67/10 ARE RELATED TO HIS ARTHRITIS. (THE SCORES I DONT NO WHAT THEY MEAN). TITLE (MD MS RHEUMATOLOGY SECTION). I submited this to my VA rep today, He said that a reconsideration will be the next move and also we will watch for the NOD date, He also stated that the doctor did a DAMM GOOD JOB. ( I HOPE THAT THIS NIGHTMARE WILL SOON BE OVER). PS I HOPE THIS HELPS SOME OTHER VETERAN.

HELLO, Again I just don't beleive what my VA REP tells me, I called and told him that I had new evidence in support of the claim concerning the DENIAL for RAYNAUD'S DISEASE, I told him I will wait until my other claims were finished, He said NO bring the evidence in right away and he would fill the reconsideration or NOD. Now if I am correct this will hold up my other claims, I took his advice before hesitantly, He said that my claims would not be held up on other issues, We filed the claim, And sure enough my claims were held up. Don't get me wrong I think there are some good VA REPS out there, But when I got the first rejection for the claim for RAYNAUD'S DISEASE being secondary to DLE, I told one other VA REP that the decision was wrong and he replied , YOU CAN'T fight the doctor (C&P examiner). Even though he was a trainee its no excuse for a !!!!!!!! statment like that. I do have another VA rep but I am also leery of him also. WHAT THE ?

  5. HELLO, BERTA, Thanks for the imformation. The only link that I have for Raynaud's to be secondary is that I have DICORD LUPUS ERYTHEMATOSUS. I had this disease since 1976 whitch was misdiagnosed by the VA DOCTORS when I was in the service, they thought I had psorasis, I did not find out what I had until 1986, the damage was done by then, I did not file until 2002 for benifits from the VA because of my lack knowledge. I will file for a reconsideration on this claim denial when I get the decisions on a few other claims that is already in the system since May of 2010, One of the claims is for a reconsideration for MDD that I put In at the end of August 2010, It has been in the system for six months and counting, The original denied claim for RAYNAUD'S PHENOMENON was August 17, 2010 I guess I have to watch the time frame for sure when I file for a reconsideration on this RAYNAUD'S claim. AGAIN THANKS FOR THE INFO.

  6. HELLO, I just talked to my VA Rheumatologist doctor about my problem with my C&P exam doctor stating that RAYNOLDS DISEASE was'nt secondary to DISCORD LUPUS. THE C&P doctor stated that RAYNOUDS PHENOMENON may be associated with LUPUS but not caused by it. So the VA denied my claim, Stating what the C&P examiner wrote, That the diagnosed Raynauds Phenomenon is not secondary to service connected DISCORD LUPUS ERYTHEMATOSUS. The examiner stated that the two conditions may be associated, but Raynaulds is not casused by LUPUS. Therefore, service connection for this condition cannot be granted on a direct, secondary, or presumtive basis, and sevice connection is DENIED. My VA Rheumatologist doctor said she would write a later in support of my claim disagreeing with my C&P examiner statment. I hope this and the VA training letters will be enough for filling a NOD. I will wait until my other claims are finished before filling a NOD OR RECONSIDERATION.

Obviously, you will need to file a Notice of Disagreement citing the training manual but don't lose sight of other issues in that Notice of Disagreement like effective date under 38 USC 5110, 38 CFR 3.400, treatment within the presumptive period of military service under 38 CFR 3.309, entitlement to benefits for dependents under 38 USC 5110 (f), eligiblity for service disabled veterans life insurance. Last I heard there was something like a 2 year window after a service connected veteran was given a 0% rating to apply for service disabled life insurance on the new condition. Also don't forget that you need to aubmit a dependents form (entitled something like Declaration of the status of dependents) along with certified copies of you marriage certificate and childrens' birth certificates within one year of award. [see 38 USC 5110 (f)].

DONT worry about hijacking my thread, because you are right, I was thinking the same thing as you were, As for every RO the processing of claims is differant and the rating system is also, Thats just the way it is for now, I can only imagine the pain and suffering also confussion that alot of our VETERAINS have to go through that is much more disabled than me, also I do feel for the raters because they are thrown under the bus, It has to be a nightmare at times. (I think someone left the barn door open during a thunder storm).

  9. The above statement "every RO has it's own system & organization" I find this as the MAIN problem with the entire VA system!! Veterans and their advocates are at a complete disadvantage when dealing with RO's when each one has it's own system!!

    Kind of makes me think the VA does not really have a model operational system for the field and have not been able to come up with one in 75 years?? This alone could and would speed up the claim system if every RO DID do it the same! People and parts could be interchangeable and would benefit the veterans and their advocates rather than hearing all kinds of different terminology on not only the internet forums but also word of mouth from vets!

  10. HELLO, VELDRINA I will try to explian my IU claim again. I filed for an increase rating for DLE SEPTEMBER 2009 I was rated at 30 %, The VRO granted my request, and raised my percentage from 30 % to 60 % in (AUGUST) 2010 of last year, I was also granted a 30% rating for MDD IN (SEPTEMBER) 2010 of last year therefore making me 70 %, The MDD claim was filed in DECEMBER of 2009. The VRO stated on the AUGUST 2010 award decision letter that they would incease my rating for DLE and they also DEFERRED a rating for IU. I guess it was automaticaly DEFERRED because of the 60% total rating. All the nesscesary forms for IU was filed out and sent back to the VRO at the end of september of 2010, So my question is, If IU is granted what would be the IU compensation start date? (SEPTEMBER OF 2009 DLE claim filed date). ( OR WHEN I FILED OUT AND SENT BACK ALL THE NECESARY FORMS AND PAPER WORK FOR IU IN SEPTEMBER OF 2010).

  11. HELLO TO ALL VETERANS, I went to my veterans regional office last week to ask for my C file. I was told to wait because it would slow my disability claims process down. I guess I have to believe them because two people said that it would slow my claim down (at the same time) also I was told to wait until I got my decisions back on my existing claims first, The reason I wanted my C files is because I want to try to stay one step ahead of VA because you nerver know whats going to happen with your disability claim decisions. The intake worker was pretty nice she looked up my claims,and she told me that my claim was with the SUPERVISOR, whatever that means, As for EBENIFITS It states that my claim is in the DEVELOPEMENT STAGE 1 for four months or longer, forget about iris its a waste of my time, Any ideas what this means when the SUPERVISOR has your claim on there desk ? Maybe it's because I asked for a reconsideration on a mistake they made on a earlier disability claim decision. Also If any one knows when a IU claim takes effect if it was deferred on a claim that was granted in the month of AUGUST 2010 that made me 60%, The original claim that was filed in the month of SEPTEMBER 2009 and the paper work for IU was sent in around the middle of SEPTEMBER of 2010.

HELLO, My fellow VETERANS, IRIS has a new web site, I wasnt able to use the other web site for six months, I was getting a CGI ERROR on six different computers, So I said to myself great I will submit a question, Its a diamond in the ruff hahahaha. I no longer get a CGI ERROR, But I get a message stating, (DUPLICATE SSN NUMBER ALREADY EXISTS FOR ANOUTHER USER, PHONE NUMBER EXISTS FOR ANOUTHER USER, AND EMAIL EXISTS FOR ANOTHER USER). WHAT THE ####### IS GOING ON NOW ? WHAT A CROCK, DOES ANY KNOW WHAT THIS IS ABOUT?

Well like i was saying so much for this great part time pick and choose working system, I guess what I have been witness to in my endeavor with the VA, it does'nt surprise me that it does not work for all vets. I"ve been trying for three months to log on IRIS. I would say I used about eight different computers. I wasted nine hours or more on this overated system. I did everything that they told me to do except throw away eight computers that I used. Sometimes it makes me think that they have a special code in their main frame when my name pops up !!!!!. I give up on that, its a waste of my time. It works for some of our beloved VETS which is good, more power to them. But sad to say not for me. I guess I pulled the short straw, snake eyes, "ene meany mine moe catch a tiger by the toe you get my drift".

  14. Now I no why 40% of homeless people are Veterans, this is ridiculous!!!!!!!!!!! For the VA to waste my time and theirs, What happened to the duty to assist letter? If it is in the VA Disabilty Claims Training Manual, that Raynaulds Disease is secondary to DLE, Why reject my claim that Raynaulds Disease isn't secondary to DLE. Can the C&P examiner change the rules that govern the rating system? What is the Training Manual for!!!!!!!!!!! BS.

  15. My claim for Raynauds disease secondary to discord Lupus erythematosus was turned down by the VA. The C&P doctor stated that in my opionion is that it is not secondary to DLE. Raynauds phenomenon may be associated with Lupus but it is not caused by it. IN the VA training manual it states,( In Raynaulds disease there is no underlying cause. This is the milder form, And it usually affects both hands and feet. In raynauds Phenomenon. Altjough the signs and symptoms are the same an underlying cause is known. one of the causes include LUPUS ERYTHEMATOSUS). I DONT UNDERSTAND THIS. ( ANY SUGESTIONS).

I have tried several different computors and I still cant get into Detroit va iris system, I have tried for months no luck', maybe they are so far behind they dont have enough manpower needed to operate this so called hi teck system, anybody out there having the same problems? I keep getting a CGI ERROR THIS SPECIFIED APPLICATION MISBEHAVED BY NOT RETURNING THE A COMPLETE SET OF HTTP HEADERS, I beleave they shut the system down. Like i said i have tried at least eight differant computors.

  17. I have tried to get through IRIS several times, to find out about why my IU claim was closed. But cant get through, I keep getting a CGI ERROR! What the heck is this HTTP THINGY. Ive tried seven defferant PCS, same results. Any ideas?

  18. I did talk to a dav rep, Thursday, and he made a few phone calls and said that they were still working on my IU claim. They could not give me any information about IU and he did say they had deferred my claim for a Cataract in my right eye. Also my reconsideration for a increase rating for MDD.
