More Mess From The Va

Question

I got an IRIS today stating "Your claim file is currently with our appeals Team to address a NOD you submitted. Your file will be referred to the Post Determination Team to complete your claim for auto allowance and service connection for sleep apnea upon completion of the appeal action."

The NOD I submitted was for my right knee where they increase me to 20% for moderate degenerative arthritis as diagnosed by C&P examiner. I submitted to them progress notes from the Orthopedic Surgeon at the same VA hospital stating that I had severe degeerative arthritis with a large concave area in the tibia and that I was in need of a knee replacement. I stated to them that the evidence shows my true condition and that a higher rating is warranted. This was over a year ago and they are just now reviewing my NOD? They had asked for additional information in August 07 where I sent them a letter from VA with my sugery date for knee replacement(Jan 08).

I wonder how long will it take them to figure this one out?

Jay, your situation is not unlike mine. I do wonder if these folks know what they are doing?

I really dont think they do. I think is must unorganized chaos at the Regional Offices.

I have written IRIS inquiries and outlined issues to make them clear and one time they actually did it.

Stall tatic is most common for these folks.

A Veteran is a person who served this country. Treat them with respect.

A Disabled Veteran is a person who served this country and bears the scars of that service regardless of when or where they served.

Treat them with the upmost respect. I do. Rejection is not a sign of failure. Failure is not an option, Medical opinions and evidence wins claims. Trust in others is a virtue but you take the T out of Trust and you are left with Rust so be wise about who you are dealing with.
