I Am Wandering If I Should Close My Appeal

Any advice on if I should close my appeal? They said it will be 2 years for any type of answer. I have an appeal in for IU. I was thinking of just paying for an IME and open a new claim for IU and canceling my appeal especially since the claims process is only about 8 months compared to 2 years. I was told an IME can weight a lot of VA decision, I already forwarded the VA my SSDI decision of approval. Any thoughts or advice much appreciated.

Never Never close any appeal. Closing my appeal on advice from the "stinking DAV"lost me $10,000 in back pay so I could get my GI Bill benefits before time ran out... Do not close out anything, wait 2 years its money in the bank.

they will have to go back to your original filing date. and you get the back money anyhow...

Arch 100% VA 100% SSDI 10% present and not accounted for :)

Close an appeal? Start over? Lose Effective date and money? You may rethink pulling your appeal out of the que; 2 years said who (in writing? or verbal words?). I suspect you are probably closer to getting a decision than you think. Do you have any associated appointments? Say Industrial Survey? or other correspondence to fill out? Have you called VA 1-800 to check the status of your claim?

Am not sure, but is there a reason why 'not' to have an IME meanwhile? Maybe ask around here, Best to ya, cg

Well I did Notice of Disagreement in June I believe and yesterday they said it was not even with DRO yet. I am in Chicago and they told there is a huge backlog of not only claims but Appeals. Not sure what Industrial Survey is and no have not had any appointments. I am scheduled for a review of my Temp 80% SC in April they said.

Hang in there, your dates are too important to 'let go' and begin again. April will be here before you know it! Meanwhile, if you can and want to do an IME, thats good backup if you prefer and can get it. Do you have a VSO to help you?

By the way, I believer the industrial survey is connected to tdiu application. Have you researched tdiu here or on the VA website? I believe once the tdiu claim starts to process, the survey is an appointment that takes information on the vet. See it under VA exam worksheets. Best to ya, cg
