Question

Hello folks, I am in the end stages of perfecting my claim for SC for multiple disabilities. I am currently receiving Non-Service Connected Pension with the following ratings..40% Hepatitis C,,30% lowback disorder,,20% rt. shoulder disorder,,10 + 10% for each knee[bilateral]..i am pursuing a SC claim for Hep.C and have built a very strong nexus...My question is..How much weight do you feel the rater/? will give my prior award of 40% for Hep. C [Non-Service Connection} torwards my Service Connection Claim for the same disability???[Knowing that they're told, not too consider NSC awards when deciding SC claims. I can't seem to think they won't,maybe not..] Feedback Please, thanks >>>william n

They will consider the diagnosis along with any evidence you have to consider it service connection.

Monte Wilson of Vietnam Veterans of America told me how he got the first SC Hep to airgun win from VA.

The vet had 2 tattoes (usually VA says that is what caused the Hep) but never was an IV user ( VA looks for that to deny)

He used a study from England which I posted here long ago to get the VA to award this claim.

I am assuming but could be wrong that this is the same type of Hepatitis that you have-

Also if you can prove you got a blood transfusion in service that can ultimately be found as part of any tainted blood batch (possible) you can use this evidence for direect SC award-

If a NSC vet gets an SC award- often the NSC amount is still higher than the SC rating.

As I understand it a vet can only election direct SC comp or NSC pension

and not both at same time.

When thousands of Americans faced annihilation in the 1800s Chief

Osceola's response to his people, the Seminoles, was

simply "They(the US Army)have guns, but so do we."

Sameo to us -They (VA) have 38 CFR ,38 USC, and M21-1- but so do we.
