am printing it off right now Tbird and will reply-

I could write a BOOK about the VCAA part-

Unfortunately the actual law on the VCAA is very technical-

I am sure I posted a topic here solely devoted to what the VCAA means and what the legal VCAA Notice and Election form is.

berta thank you this is a big help. i would like to use some of your posts as articles on the main site and would appreciate your input on what kinds of questions repeat for you.

others jump in here. if we have posted the same information over and over than chances are it should be it's own article.

Tbird-

This is good- all I could add to the .rtf is

under Apply For Benefits-

maybe to add - for service personnel applying for compensation prior to discharge date and who file within one year after discharge, the retro date is is the first day after discharge.

( many inservice mil are applying before discharge these days)

Under Gathering Evidence

maybe any available Private medical evidence should be there too if there is a pre-existing condition that service could have aggravated.

The criteria and ways to develop CUE claims is all here-ad finitum!

I repeat a lot as to how to fill out the TDIU form too-

make sure to tell VA of the side effects of any SC meds to employability

make sure to tell VA if you get SSA and tell them if it is solely for the SC condition

make sure to tell VA if Voc Rehab ever turned you down due to SC.

I recommend under # 25 Remarks to refer them to additional page as needed with the c file # etc on it.

I am sure the whole criteria for the different types of DIC is here already.

SMC also has been posted here too many times as to its lengthy criteria-

but many high level SMC claims are so unique it is often hard for the vet to determine what level the VA should award without some good discussion here.

Nehmer- I am sure everything about Nehmer is here in the search feature-

EVERY AO vet should read the Nehmer Court Order and Stipulation when they get their award- to make sure the VA fully paid them proper retro under the Nehmer provisions.

It is all explained at NVLSP web site too.

FTCA and Section 1151 claims also have a lot of info here available under a search already-

The BEST advise of all we can give for a FTCA claim is to encourage the veteran to get an attorney.

If the Statute of Limits date is close they can file the SF 95 themselves- but they still should get an attorney.

IF the VA denies an FTCA claim and they dont have an attorney- regardless of whether the VA denial is right or wrong- at that point we can't really help them here.They then have to file the case in a Federal court and that definitely needs an attorney's help.(unless they want to spend lots of time studying medicine and the fed ct laws)
