Rom Results For Ankle.

Question

I just got the results back from my C&P exam. Can someone tell me about what percentage I should be for this ankle injury according to the 38CFR.

I am a little confused at what the rating should be.

Right Dorsiflexion; 0 to 12 degrees

Right Plantar Flexion: 0 to 15 degrees

Probably 20%.

Can someone explain how the Deluca factor works.

I have seen them mention Deluca as most of the Ankle issues center around the ability to move the ankle, dorsiflexion, and Plantar flexion. Deluca was a case where they argued that pain was taken into account. I currently have a Plantar Flexion from 0 degreees to 2 degrees, and dorsiflexion from 0 to 7 degrees with no Deluca indicators on the C&P exam so I am currently waiting on what the AMC raters will do with that. Now my IMO indicated that I have pain so we will see.

I think Deluca was good because even if you could move the ankle does not mean it is painless, and it forced them to factor in pain. If you have an Ankle issue they will sometimes watch you from the whole time you leave and then to the parking lot, and into your car. I have read a few of these cases where it was pretty obvious someone was faking it and they mention it in the report. It is truly sad.
