C&p Report Question

Question

Hello all,

I just received my C file and was looking at a C&P report done for sarcoidosis "that was denied" When asked on the report is it at least likely as not that the sarcoidosis is due to military service he answered YES. The thing is that I did not have any entry in my SMR and it was over a year from discharge that I was diagnosed with the disease, but I did send in a study from the Navy that shows a direct link from non skid grinding to sarcoidosis. I provided evidence that I was exposed to the dust and had a C&P pulmonary exam that shows I have pulmonary problems. What do you think I should do with this info.

Request they reopen your claim with new evidence.

If it has been less than a year since the denial then simply submit a Notice of Disagreement.

If you are outside of the one year period then you will have obtain new and material evidence to re-open the claim. This new and material evidence will have to directly address the reason for denial which was probably something along the lines as no evidence of the disability occurring in service.

Just curious, but could you post the exact wording of the denial from the rating decision?

You are right Clown Man they said that no record in SMR and it was pure speculation on the doctors part to say that it was service connected. It has been over a year so I do not know what new evidence I can give them.
