Nod Appeal

:) I Was going trough all the paperwork I have since I filed my NOD last oct. I noticed that on one of the letters my VSO sended to Va, he Requested a traditional appeal proces to take place. Back then I didn't know a thing about the Va appeal process. Now that I know a little bit thanks to hadit, I ask myself and you guys, why my VSO didn't ask for an DRO review first?, and, if that failed, then go to BVA. I'm really mad cuz of this and will talk to my VSO about this next week. Also, I call IRIS and they told me the appeal is already on it's way to the BVA. I have a 2nd NOD for PTSD, that one with DRO review requested and I'm thinking to have another VSO handle that NOD for me.

Back to the issue of the NOD that's on it's way to BVA: I have a spine c&p this weekend. What's Going to happen after the c&p? Are they going to take years to make a desicion? What should I expect?

I think you can expect a much longer wait by way of the BVA vs a DRO review. That is why I always file my own paper work, I never rely on any VSO. When it comes to NOD's, I always ask for either a DRO review of hearing. However, If you still insist on using the VSO's than I suggest you do all the work yourself and give the completed documents to them to turn in on your behalf. Remember, no-one cares about your claim more than you yourself. As I said I do all my own filing in order to obtain a time stamped copy for my records and because I want to control my own VARO destony as much as I can.

Before an appeal actually goes to the BVA you get a letter advising you it will be transferred-

but evidence however can continue to be supplied to the VA.

The actual "transfer" often doesn't happen until the docket number is getting closer at the BVA.

I am assuming that since you had the spinal C & P recently-the spine claim is not the claim that could be going to the BVA.

When you received a Statement of the Case they should have included an election form for you to decide whether you wanted DRO review or traditional appeal.

If they dont have a BVA election for traditional appeal signed by you-maybe you could question this and request the DRO review instead.

could continue to submit additional information.

Since it going to BVA you can submit a Waiver of Regional Office Consideration

if you want to.

Carlie: how should I do that? Is there anything specific I have to write down on the letter? I just had my spine c&p done today. The examiner told me the results are going to b send to Waco VARO. I hope they try to resolv my claim here and keep it llocal instead of sending it to BVA.

If the spine condition is part of the same appeal they said that was going to the BVA-then they sure did --k up-if they made a decision without even seeing the C & P results.

What disability is the NOD for -that is going to the BVA ?
