Question

I received decision letter states entitlement to IU and basic eligibility to dependents educational educational is established,90% SC IU 100%, have IHD claim being deferred till regs for ao.Called 800# asked for a letter stating i'm 100%P&T ,i was immediately fax the letter to use for state bennies.I called back the 800# in reference to a state form i needed the DVA to sign stating i was 100% P&T for property tax exemption and was told i had future exam listed next year which conflicted with 100% P&T,I then sent inquiry to IRIS.I spoke to service officer and he stated i was P&T being i was awarded chapter 35 and he told me to fax tax exemption to him and he would walk form across the hall to DVA and they would mail completed form to me.Future exam he stated was probably my IHD claim,I received reply from IRIS stating i'm 90% sc 100%IU NOT P&T.I replied to IRIS how could i have been established dependents educational assistance in decision letter and not be P&T.

Does anyone know who's on First? :D

The people you are dealing with are idiots. TDIU is actually better protected than P&T and the reason I know is I am P&T

This message is in response to your inquiry dated April 2, 2010. Our records indicate that you are rated at 90%, being paid at the 100% rate due to individual unemployability. You are not currently rated 100% Permanent and Total (P&T). We are very sorry for any confusion. Veteran's receiving individual unemployability are the exception to the rule that a Veteran must be rated 100% P&T to receive Dependents Educational Assistance (DEA) benefits. Because the unemployability benefit can always be taken away if the Veteran begins working again, the rating can't be made permanent. Also, unemployability is granted to Veteran's rated less than 100%, so their rating isn't total, total being 100%. With no chance of of the rating being permanent, there is no way to grant Permanent and Total.

I will never call 800# or IRIS again they make up there own rules "EXCEPTION TO RULE FOR DEA IF YOUR NOT P&T but are IU .i never heard of exception.

I will bet that Hadit has dozens here that have TDIU with no future exams scheduled or P&T call it what you may. By your IRIS definition none is P&T cause it is easier for the VA to take away a P&T determination than a TDIU. I guess some dumbass VA IRIS person decided to get smart.

If I remember this stupidity is affecting benefits that State grants and if you have the energy you need to get them to fix their answer. If your family has ChampVA or you can get a Military ID Card you are P&T

I am chapter 61 "tricare,military id card" i already have.I'm putting this out there

to let other vets know what can happen with IRIS and 800# :D
